Pursuant to Standing Order 108(3)(g), the committee resumed consideration of the Report 1, ArriveCAN, referred to the committee on Monday, February 12, 2024.

Michael Duheme made a statement and, with Mark Flynn, answered questions.

Matthew Green gave notice of the following motion:

That, as per the usual practice of House of Commons standing committees, the Standing Committee on Public Accounts shall not meet during Parliament’s summer recess unless the requirements of Standing Order 106(4) of the Standing Orders are met.

Questioning of the witnesses resumed.

The Chair presented the Second Report from the Subcommittee on Agenda and Procedure, which read as follows:

Your subcommittee met on Tuesday, June 4, 2024, to consider the business of the committee and agreed to make the following recommendations:

  1. That the committee dedicate one meeting to Report 1, ArriveCAN, of the 2024 Reports of the Auditor General of Canada and one meeting to the consideration of draft reports prior to the summer period.

  2. That the 2024 Reports 5 to 7 of the Auditor General, referred to the committee on Tuesday, June 3, 2024, be the next reports studied by the committee.

It was agreed, — That the Second Report from the subcommittee be concurred in.

The Chair presented the Third Report from the Subcommittee on Agenda and Procedure, which read as follows:

Government now says new human rights chief did disclose key information about controversial social media posts

The news raises questions about what the government knew about Birju Dattani's online activity

The federal government now says Birju Dattani, the new head of the Canadian Human Rights Commission, did disclose the alias he used to make controversial social media posts — after it initially claimed that information was never shared before he was hired.

Justice Minister Arif Virani's spokesperson confirms that Dattani did pass on the alias to "public servants as part of the security assessment of Mr. Dattani." The minister's press secretary, Chantalle Aubertin, added that the name was not provided to Virani's office.

The news raises new questions about what the federal government knew — or ought to have known — about Dattani before he was appointed to lead the country's human rights watchdog, the Canadian Human Rights Commission (CHRC).

In June, Dattani was named the CHRC's chief commissioner, making him the first Muslim or racialized person to head the organization.

Shortly after his historic appointment, national Jewish organizations cited what they described as antisemitic social media posts made under the name "Mujahid Dattani" and a controversial appearance on a debate panel in the U.K.

The Centre for Israel and Jewish Affairs (CIJA) accused Dattani of posting articles on X, formerly Twitter, that compared Israel to Nazi Germany. The posts and Dattani's account appear to have been deleted.

CBC News has not seen the alleged posts. Dattani himself has said he did not compare Israel to Nazi Germany. He said he did share without comment an article comparing the plight of Palestinians to that of prisoners in the Warsaw Ghetto during the Second World War, adding that he didn't agree with the article's argument.

In 2015, Dattani also spoke on a panel in the U.K. alongside a member of Hizb ut-Tahrir, an Islamic fundamentalist group that seeks to establish a new caliphate and opposes Israel's existence.

Dattani said he was unaware of the other panellists' affiliations and had never met them before.

The minister's office did not confirm that Dattani used the alias "Mujahid Dattani" online and did not respond to follow-up questions from CBC. It did say that "a formal, independent review" has been launched into the matter and a public report will be published before Aug. 8, when Dattani is supposed to assume his new role.

CBC reached out to the Justice Department. The Privy Council Office (PCO) — the secretariat serving the federal cabinet and the prime minister — replied, saying that "due to the application of the Privacy Act and for confidentiality reasons, PCO is not able to comment further."

The Conservative Party of Canada has called on the federal government to rescind Dattani's appointment and wants the House of Commons justice committee to probe the matter. Conservatives have accused the government of investigating itself.

Conservative deputy leader Melissa Lantsman said the government could easily have learned more about Dattani's past through a Google search.

"It's either complete incompetence or something more nefarious," Lantsman said, reacting to the news that Dattani provided his alias to the government through the vetting process.

Despite the backlash, several groups issued joint or individual statements calling the demands for Dattani's dismissal "deeply concerning." His former employer, the Yukon Human Rights Commission, issued a statement of support for their former director.

The National Council of Canadian Muslims (NCCM) called Dattani's treatment "little more than a witch hunt." It added that the government should have stated earlier that the alias was disclosed during the appointment process. 

"Canadians deserve to have clarity on such matters. We look forward to a fair and balanced process that fully clears Mr. Dattani's name," said Fatema Abdalla, NCCM advocacy officer.

The Black Class Action Secretariat has called for reforms at the CHRC in response to reports of anti-Black racism within the organization. 

The secretariat is among the groups raising concerns about the calls to dismiss Dattani.

Reacting to the news that the government knew about Dattani's online alias, Nicholas Marcus Thompson, the secretariat's executive director, suggested the government was trying to "scapegoat" Dattani for political reasons.

"It appears that the government is trying to shift blame to the applicant, Mr. Dattani, in this process," Marcus Thompson told CBC News. "After all, it's now coming to light that he did provide information about his alias, which he was required to do."

A Senate committee report says anti-Black racism and other forms of discrimination are pervasive at the Canadian Human Rights Commission and the federal public service.

CBC has seen a blank copy of the application form Dattani would have used to inform the government of his online alias. The form states the Privy Council Office needs the information to determine the candidate's "suitability for public office."

It also says applicants undergo background checks through the RCMP, the Canadian Security Intelligence Service (CSIS) and the Canada Revenue Agency, along with "a search of publicly available records (including social media, court records, news reports, etc.)"

Dattani would have had to clear the PCO background check before being appointed to the top job at the CHRC.

Through his lawyer Muneeza Sheikh, Dattani declined to comment. 

Sheikh referred CBC to a statement she issued about her client. In it, she said Dattani was "the victim of a smear campaign by a small number of organizations looking to discredit him and the CHRC."

"Some of these organizations (and people) have demonstrated a pattern of attacking Muslims in leadership positions," she added. "They have accused Mr. Dattani of hiding his past online conduct from the CHRC — this is false."

In an interview, CIJA's vice president of external affairs and general counsel Richard Marceau said there's a problem with the federal government's vetting process.

"If they willingly appointed somebody with this problematic past … that would be very worrisome for the Jewish community," Marceau said.

Liberal MP Marco Mendicino said "there are significant deficiencies" in the screening process for public appointments that need to be fixed.

"A rigorous vetting process is required so that the public can have the utmost confidence in the chair and the CHRC as a protectorate of human rights in our democracy," Mendicino said in an email. 

Dattani's appointment to the CHRC comes as the commission faces intense scrutiny. 

In March 2023, the federal government reported that the CHRC had discriminated against its Black and racialized employees. The government's human resources arm, the Treasury Board of Canada Secretariat (TBCS), came to that conclusion after nine employees filed a grievance through their unions in October 2020.

Canada’s human rights commission admits it has dismissed a large number of complaints about racism, with numbers showing the commission dismissed a higher percentage of race-based claims than it did others between 2018 and 2021.

A United Nations-affiliated oversight body is now reviewing the CHRC's accreditation with the UN Human Rights Council (UNHRC).

The Department of Justice also ordered last year an external investigation into claims that Michael Gottheil, CHRC's accessibility commissioner, had mistreated staff.

In a statement sent through his lawyer to CBC News, Gottheil confirmed the existence of the investigation but said his understanding at the time was that no formal complaints had been filed.

Madam Speaker, there is indeed an emergency in this country. Indeed,
there are a series of emergencies.
There is the emergency of the family whose 14-year-old daughter has
attempted suicide after two years of isolation from sports, social
interaction and other healthy activities that sustain a happy and
heartful mind. There is the emergency of the federal public servant
who, for unrecognized medical reasons, cannot get vaccinated and is
now deprived of an income and a job. There is the emergency of the
trucker who was hailed as a hero while driving our goods and services
across international borders unvaccinated for over two years, who
suddenly was declared a public health threat and deprived of his job
as well. There is the emergency of the 32-year-old still living in his
mom's basement, because under the pretext of COVID, the government
printed so much money that it now costs $836,000 for the average
house. There is the emergency of the single mother trembling as she
walks down the grocery aisle because she cannot afford a basket of
affordable goods, because the government has inflated her cost of
living. There is the emergency created by the regulatory gatekeepers
who keep people in poverty by blockading first nations people from the
ability to develop their own resources and blockading immigrants from
the ability to work in the very professions for which they are trained
and qualified.
These are the emergencies we should be addressing, but instead, the
Prime Minister has created a new emergency. What is his motivation? Of
course, it is to divide and conquer. How did this all start? Let us
remember that the Prime Minister suddenly imposed a brand new vaccine
mandate on the very truckers who had been free to travel across
borders without a vaccine, and he did it at a time when provinces and
countries around the world were removing vaccine mandates. He did it
to a group of people who are by far the least likely to transmit a
virus because they work and sleep all by themselves 22 hours a day.
Media asked his health minister and his chief medical officer for
evidence supporting the decision. Neither had any. In fact, the
medical officer said it was time to return to normalcy, yet the Prime
Minister, in spite of all these facts, brought in this new mandate to
deprive people of their living, because he knew that it would spark in
them a sense of desperation. If he could deprive them of their
incomes, they would be so desperate that they would have to rise up
and protest, and then he could further demonize them, call them names,
attack their motives, belittle them and dehumanize them in order to
galvanize the majority against the minority.
This must be the political opportunity his Deputy Prime Minister spoke
about when she described what COVID represented to the government. The
Liberals have attempted to amplify and take advantage of every pain,
every fear and every tragedy that has struck throughout this pandemic
in order to divide one person against another and replace the people's
freedom with the government's power.
At the beginning of the pandemic, it started immediately. The
government attempted to ram through a law that would have given it the
power to raise any tax to any level for any reason without a vote in
Parliament. It tried to pass Bill C-10 to strip away free speech
online. Thankfully, Conservatives blocked it from doing so. The Prime
Minister's authorities have said they want to track Canadian cell
phones for the next five years. Now this, the Emergencies Act, is the
latest and greatest example of attacks on our freedom.
Ostensibly, it was meant to stop blockades, which had already ended
before he even brought forward this legislation. In Alberta, in
Manitoba, and at the Ambassador Bridge, those blockades were ended
peacefully, in some cases with protesters hugging the police officers
and bringing the matters to a successful close so that goods and
services could resume.
Instead, in that context, the Prime Minister brought in a law that not
even Jean Chrétien brought in after 9/11 killed dozens of Canadians in
a terrorist attack, that not even former prime minister Harper brought
in when a terrorist murdered a Canadian soldier at the war monument
and came running into Centre Block spraying bullets in all directions,
and that not even the current Prime Minister brought in when blockades
by first nations were standing in the way of those who were attempting
to build the Coastal GasLink pipeline. For the first time in this
law's three-decade history, the Prime Minister brings it in to address
what he says was a protest in front of Parliament Hill.
Ironically, this power goes beyond any of the protests and/or
blockades the Prime Minister claims to want to address. For example,
it would allow governments and banks to seize people's bank accounts
and money for donating to the wrong political cause. One journalist
asked the justice minister if small sums donated, for example, to
support an end to vaccine mandates could get someone's bank account
frozen. The minister did not deny it. Instead, he said that people who
make donations of that kind should be very worried.
To freeze people's bank accounts is not just an attack on their
finances but on their personal security. If their bank accounts are
frozen, they cannot buy food, they cannot buy fuel, they cannot pay
their children's daycare fees and, under this law, they can face this
personal attack without being charged with a single, solitary crime.
The Prime Minister says that this is time-limited, yet his own finance
minister said she wants some of the tools to be permanent. He said it
will be geographically targeted, yet his own parliamentary secretary
for justice said that “the act technically applies to all of Canada”.
The rules apply everywhere and indefinitely.
Finally, there is nothing in the act that limits the kinds of
financial actions that could lead to people's accounts being frozen,
and if they are frozen unjustifiably, the act specifically bans people
from suing either the bank or the government for that unjustifiable
treatment, opening the door for people who have nothing whatsoever to
do with either the blockades or the protest having their bank accounts
frozen without cause.
The Prime Minister says he wants to do this to remove the blockades,
blockades that have already been removed. He says he needs these
unprecedented powers in order to bring our country's order back to the
pre-protest period, although across this country that has already
occurred.
I say to the House that I oppose this unjustifiable power grab and, as
prime minister of Canada, I will ensure that no such abuse of power
ever happens again.
However, I say that we should end some of these blockades. Madame
Speaker, we can remove all of the blockades. Let us remove the
mandates and restrictions that are blocking people's livelihoods
today. Let us end the blockades on freedom of speech that the
government is trying to erect with its online censorship bill. Let us
end the regulatory blockades so that builders can provide affordable
homes, first nations can develop their economies and escape poverty,
and newcomers can actually work in the professions for which they were
trained. Let us remove the inflationary taxes, deficits, and money
printing so that people's wages can again buy them homes, food and
fuel, let us remove that blockade.
Let us get people back in control of their lives by making Canada the
freest place on earth: free to speak, free to think, free to work,
free to worship, free to own a home and build one's own destiny. Let
us bind up the nation's wounds with compassion and respect and unite
our country for freedom.

Conservative Leader Pierre Poilievre has released his list of
parliamentary critics. He's chosen Alberta Conservative MP Jasraj
Singh Hallan as the party's new finance critic, pitting him against
Deputy Prime Minister and Finance Minister Chrystia Freeland.

Poilievre has appointed 51 critics and another 20 associate critics.
But the list leaves out some very high-profile Conservatives, such as
MP Ed Fast — who supported former Quebec premier Jean Charest for the
leadership — and Michelle Rempel Garner, who served as leadership
campaign co-chair for Patrick Brown.

Former Conservative leader Erin O'Toole told the National Post last
month that he did not want a critic role because he did not want to be
a distraction to the team. He was left off the list.

Poilievre named Quebec Conservative MP Gérard Deltell as the party's
environment critic. Minister of Environment and Climate Change Steven
Guilbeault is also from Quebec.

Minister of Intergovernmental Affairs, Infrastructure and Communities
Dominic LeBlanc will face off against Ontario MP, former leadership
candidate and prominent social conservative Leslyn Lewis, who becomes
the new infrastructure and communities critic.

Rob Moore, MP for the New Brunswick riding of Fundy Royal, has been
named the new justice critic, pitting him against Justice Minister and
Attorney General David Lametti. Defence Minister Anita Anand will do
battle with new defence critic MP James Bezan.

mandates, has created a new position of civil liberties critic for

Last year, Gladu led the formation of a "civil liberties caucus" of

Gladu told CBC News that her new role, which does not have a

Ontario MP Melissa Lantsman, a lesbian, and Alberta MP Tim Uppal, who
is South Asian, now serve as Poilievre's deputy leaders. Both
supported him in the leadership race.

Since her election last year, Lantsman, a former political staffer,
lobbyist and CBC commentator, has been a fierce critic of the
government's handling of the COVID-19 file.

Uppal, who represents Edmonton in the Commons, served as minister of
state for democratic reform and later as minister of state for
multiculturalism in former prime minister Stephen Harper's government.

Former Conservative leader Andrew Scheer, who was also a strong
supporter of Poilievre during the leadership contest, was named
opposition House leader.

Thank you for your email. My office has been inundated with similar emails.

On Monday February the 21st, the Liberals and NDP voted in favour of the Emergencies Act and called the situation at hand a public order emergency. It was the first time that this act has ever been used and the act preceding the emergencies act was only used in WW1, WW2 and the FLQ Crisis. This vote was specifically disturbing because it occurred despite the fact that all of the cross border protests were concluded and the one in Ottawa was disbursed and disbanding. It was a dark day for personal freedoms and peaceful protests in Canada.

The Prime Minister appears to have made no effort to de-escalate the situation. Instead, he has insulted and disrespected Canadians, and then when it blew up, instead of apologizing and listening to what people had to say, jumped straight to the most extreme measures to deal with the protests.

Imposing powers of the Emergencies Act sets a dangerous precedent. The Government of Canada included in its laundry list of powers the ability to freeze the funds of those supporting the demonstrators. Governments should not have the power to close the bank accounts of hardworking Canadians simply on the suspicion of supporting causes of which the government doesn’t approve. This is a slippery slope, and not how the government should operate in a free and democratic society.

Some of my comments are contained in this speech I delivered in the House of Commons on behalf of constituents. It is worth watching as it clearly shows where I stand and the actions that I personally took to stop this government overreach. The video can be viewed here: https://fb.watch/bmjT0H1Fs2/

In an even more baffling turn of events, less than 48 hours after voting to implemented the Emergencies Act the Prime Minister announced on February the 23rd that the “situation is no longer an emergency” and revoked the Emergencies Act. Although it is unnerving to even consider that the PM would invoke the Act to silence his political adversaries, I am thankful that the direct, powerful and prolonged pressure by Conservative MPs and engaged constituents such as yourself seems to have impacted his decision. In the words of our interim Conservative Leader “Nothing has changed between Monday and today other than a flood of concerns from Canadian citizens, bad press, and international ridicule.”

This is not a win, our work is not over yet. What all Canadians need now is a clear plan out of this pandemic by ending the mandates and a return to normal life. Unfortunately, the Liberals and NDP are unwilling to even discuss a plan for Canadians and unwilling to put their political differences aside.

I will continue to be your strong voice in Ottawa and I hope that I can continue to count on your support as I hold this government to account for their actions.

Sponsored travel by MPs questioned amid foreign interference claims

Dominic LeBlanc once took paid trips to Taiwan and Israel.

Ginette Petitpas Taylor had travel paid for by the government of Qatar.

More recently, John Williamson and a group of Conservative MPs grabbed headlines for their trip to London.

Williamson’s tab was paid for by a think tank in Hungary.

The sponsored travel accepted by New Brunswick MPs, and dozens of other politicians, is commonplace on Parliament Hill where it’s entirely within current parliamentary ethics rules for members to accept trips to destinations all over the world as long as the purpose, cost, and sponsor of the trip is publicly disclosed.

But amid growing concerns of foreign interference in Canada’s elections and a bombshell report by a committee of parliamentarians that found some unnamed MPs are “witting or semi-witting” participants in foreign meddling, there’s now calls for it to end.

“Is there really a free lunch in politics?” Green Leader Elizabeth May said last week.

“I don’t see any reason that a member of Parliament should accept a free trip anywhere from a foreign government. I don’t think they offer free trips to visit their country without expecting that they’ve at least influenced the MP a bit.

“I just think it is bad practice and while we’re tightening up the rules and looking at foreign influence and foreign interference, I think they should not be allowed.”

May herself took a trip in 2018 that was sponsored by the Palestinian Authority to visit disputed territories.

She says she’s since reimbursed the costs of that trip.

Asked by Brunswick News about the value of sponsored travel and whether it should still be allowed, Williamson also suggested the rules should be tightened.

“Foreign interference is a problem for an unknown number of Trudeau Liberal MPs and if sponsored travel is enabling foreign agents to capture members it should be limited or ended,” Williamson said in an email.

The New Brunswick Southwest MP’s disclosure shows his travel to London last June was paid by the Danube Institute, based in Budapest.

He left Ottawa for London three days before the House of Commons adjourned for summer break to attend a meeting of the International Democrat Union, a global conservative political organization currently chaired by former prime minister Stephen Harper.

It also states that Williamson met on the topic of energy with the IDU and U.K. parliamentarians.

Roughly $4,000 in flight costs and $7,000 in hotels are listed.

That trip grabbed national headlines as Conservative MPs Stephen Ellis, Rosemarie Falk, Shannon Stubbs, Phillip Lawrence, along with Williamson, dined at high-end restaurants including the Savoy, Bentley’s, and the Guinea Grill.

The dinner at Bentley’s oyster bar came to $404.87 a person. The tab at Guinea Grill shows several expensive bottles of wine and champagne on the bill.

The sponsored travel registry shows Moncton-Riverview-Dieppe MP Ginette Petitpas Taylor was part of a delegation of Parliamentarians that travelled to Qatar’s capital city of Doha in 2016, paid for by the Qatar government.

Petitpas Taylor brought her husband, according to the documents.

Qatar covered $5,743 in flights and $1,000 for a hotel stay.

LeBlanc travelled with his wife to Taiwan in 2014 on a trip paid for by the Chinese International Economic Co-operation Association, a Taiwanese business organization.

That included $9,120 in flights and $2,128 for a hotel in Taipei.

LeBlanc, his wife, and stepson also had a trip to Israel paid for by the Canada-Israel Committee, now known as the Centre for Israel and Jewish Affairs.

In disclosure documents, LeBlanc wrote that it was to “meet with Israeli government officials, parliamentarians, and defence forces.”

Roughly $15,000 in expenses were covered.

MPs racked up $840,000 in 2023 on travel bills paid for by lobby groups and foreign countries, nearly four times what was spent five years ago, according to analysis by Postmedia.

Politicians flew to 92 destinations, including places like London, Israel, Taiwan, Paris and Seoul.

That number is twice what it was in 2022, when MPs were given $412,332.86 worth of travel, and nearly four times what it was in 2019 when MPs were comped $221,627.76 in travel bills.

The pandemic years of 2020 and 2021 saw relatively little travel with only seven trips in either of those years.

Both LeBlanc and Petitpas Taylor’s offices declined requests to speak on the value of their trips.

Instead, both offered very similar statements.

“I suggest you address this request to the International Board of Economy, which is represented by all parties and makes its decisions by consensus,” Petitpas Taylor’s press secretary Isabelle Arseneau said.

Jean-Sébastien Comeau in LeBlanc’s office added: “It is preferable for this question to be dealt with by the Board of Internal Economy, which has representations from all parties and arrives at its decisions by consensus.”

A request for comment made to the board’s chair, Speaker Greg Fergus, wasn’t immediately returned.

Members of the Board of Internal Economy, which oversees the operation of the House of Commons and its spending, adopted a proposal last month made by Liberal MP Mark Gerretsen to examine exceptions to the rule that prohibit MPs from claiming expenses related to partisan events.

But that relates to how MPs can claim expenses for things like travel to a caucus meeting held at the same time and place as a party convention. It doesn’t directly deal with sponsored travel.

Last year, Lobbying Commissioner Nancy Bélanger banned any group that is federally registered to lobby from offering free trips to MPs.

Earlier this year, the House of Commons ethics committee passed a motion calling for the end of sponsored travel, with the idea to replace it with an expanded budget for MPs that allows for two international trips a year.

That moved the question of sponsored travel to the procedure and house affairs committee.

“Ultimately, I look at these trips as part of a perk that is not justifiable in the present economic context, nor is it accountable in terms of transparency and accountability,” said NDP MP Matthew Green, who put forward the original motion.

Williamson suggested the questions on sponsored travel come as Canadians want to know what MPs are helping foreign states.

The report by the National Security and Intelligence Committee of Parliamentarians, known as NSICOP, cites “particularly concerning examples of behaviour by a few parliamentarian,” including “knowingly or through willful blindness” accepting funds or benefits from foreign governments.

It further alleges these Canadian officials worked to “improperly influence parliamentary colleagues or parliamentary business” at the direction of foreign actors.

The report was heavily redacted, not naming the MPs or which party they belong to or whether they are still sitting in the House of Commons.

“The Trudeau government should reveal the parliamentarians who have helped our adversaries and enemies so they could explain themselves and be accountable,” Williamson said.

LeBlanc, the Trudeau government’s Public Safety minister, has maintained that it is up to the RCMP to investigate and lay charges if warranted, while maintaining that intelligence reports often contain “uncorroborated or unverified” information.

MPs have since voted to see an ongoing inquiry into foreign interference investigate.
