Elections New Brunswick returning officer John Campbell was ecstatic
about the recount results.

"Even [election] night I was fully confident in our process — that it
was fair, that the numbers would bear out," he said.

"And after two days of going through all the ballots, it beared out
right to the last number, so I'm quite confident and quite thankful it
turned out this way."

The closest race was in Saint John East, where Liberal Gary Keating
recorded an eight-vote win over PC Gary Savoie. One additional vote
went to Keating through the recount.

Justice Hugh McLellan won't rule yet on who picks up recount tab

Judge says it's premature to make a ruling about costs

A Court of Queen's bench judge involved in one of the judicial recounts says it would be premature to make a ruling about who should pick up the tab.

"I would like to defer making any rulings on costs in this matter until both parties have an opportunity to ask Elections New Brunswick if they would like to make a contribution to their costs," said Justice Hugh McLellan in a written decision released Friday.

Today in Saint John Harbour, a Liberal victory — and the accuracy of the vote count through computerized tabulators — was confirmed by a manual recount of the paper ballots.

Liberal Ed Doherty defeated Progressive Conservative Carl Killen by 71 votes.
"Well, I'm absolutely delighted," said Doherty, as elections officials wheeled boxes containing the 5,200 paper ballots out of the Saint John Law Courts building.

"I'd like to thank the constituents who had confidence in me. It was validated when the tabulation machine jived with the manual count," he said.

The Saint John Harbour recount, which began Thursday and concluded around mid-day Friday, was the first of seven judicial recounts to be completed.

Under provincial legislation, Elections New Brunswick must pay for recounts in ridings with a winning majority of less than 25 votes.

But in races decided by more than 25 votes, the party that applies for a recount that doesn't result in a change, must foot the bill.

Liberal lawyer Tom O'Neil requested costs of $5,000 from the Progressive Conservatives for the Saint John Harbour recount.

The lawyer for the Tories, however, argued the party should only have to pay $500 because of the unique circumstances.
McLellan declined to rule on the request for costs. Instead, he instructed O'Neil to request money from Elections New Brunswick, suggesting the agency should pony up, given the election night "confusion."

On election night, the use of an untested software by Elections New Brunswick to transmit results recorded through the automated vote-counting tabulator system saw vote counts stall and then appear to drop before finally concluding.

The resulting confusion and delays meant it was about five hours after the polls closed before Elections New Brunswick could declare Brian Gallant's Liberals had won a majority government, with 27 seats compared to 21 for the Progressive Conservatives and a single Green Party seat.

With the resulting confusion, the Progressive Conservatives applied for recounts in six ridings, while People's Alliance Leader Kris Austin applied for a recount in Fredericton-Grant Lake, which he lost by 26 votes to Tory Pam Lynch.

Recount important for 'public confidence'


The margin of victory in the Saint Harbour recount was the same as the 71-vote victory Doherty posted over Killen in the Sept. 22 election.

The manual recount turned up only one mistake — one too many votes for Green Party candidate Wayne Dryer.

Still, Killen says the recount was worthwhile.

"There was so much confusion that night and such a kerfuffle it was important I think, from the perspective of public confidence, to go through this process," he said.

Elections New Brunswick returning officer John Campbell was ecstatic about the recount results.

      For the record I refused to give Mr. Paddy Addison the original
documents today because I need them as evidence to use against the
Crown in Federal Court. The reason for me to do so should be obvious
for any clever lawyer to understand. Furthermore even the government
must admit that the folks who were good enough to affirm my rights and
sign my nomination papers have the right to their privacy. Whereas it
was the Crown that refused me my right to run for a seat in New
Brunswick's Legislature before I could file the document that is
hereto attached I truly believe it is particularly important for me to
protect their privacy. What say you?.
      However this email does prove that I at least obeyed the rules
and attemtped to employ my rights within a timely and ethical fashion
to expose public corruption in a ligit fashion in an important
politcal forum in New Brunswick. Also attached to this email is photo
of my witness to all that was said and done over the past two days.
The Crown must understand that it wasted his precious time as well.
Now the Crown is too late to correct its mistakes EH?
      In my humble opinion the Crown and the public corruption it
supports should have alowed me to run and lose according to the rules.
However it appears to me that the politicians acting against me behind
the scenes are very afraid of what I may say in a public forum in
Saint John Harbour. I know that Bernard Lord thinks that Ms. Hooton is
a shoein in his sneaky snap election. however many Maritimers
recognize when a politician is just pulling a fast one. I truly think
that Annise Hollies and Brad Green should have rethought their
positions and called me back before the Bell tolled on 2 P.M. today,
particularly in light of the material I served upon Paddy Addison
yesterday in his office as agent for the Crown and refused to take
back after he had denied me my rights.
      Now that it is Chinese Dentist time I have come screaming back
just like last year's toothache that everybody is trying so hard to
ignore. Feel free to argue me byway of your lawyers now. Cya'll in
Federal Courts.

Hey
      A rather fierce political animal  who was born and raised in the
Maritimes is about to rear his ugly head and scream bloody murder in a
very ethical and political fashion. Rest assured that I do not expect
to get elected but as a citizen I do have the right to be heard.
Raising a little hell  in an ethical fashion in a political forum
before Humpty Dumpty is forced to drop the writ on the next federal
election is a very important thing for me to do for the benefit of my
own Clan and all Maritimers as well. My concerns and interests are the
same as all Canadians who are not on the gravy train of rampant public
corruption.
         Before making a sincere and diligent effort to have my name
on the ballot in the upcoming snap by -election inspired by Lizzy Weir
and her new Little Lord, I read the Elections Act. I truly believe
that I have the right to run. However it appears that it will be the
Justice Department under the Politician Brad Green's direction that
may challenge my right to run for a seat in the legislature. I have no
doubt whatsoever that the little Lord of New Brunswick and his cohorts
will do their best to stop me for their best interests alone. Never
forget it was the Queen's men that threw me out of the Legislative
Building in Fredericton while I was running for Parliament last year
and the Justice System of New Brunswick covered up the truth of the
matter before I was falsely imprisoned in a Yankee Jail in Beantown
last year. Any smart lawyer will understand how the Sovereign immunity
of the Crown went out the window with the Holy See's.
       To head the little Lord off at the pass so to speak, the devil
made me call the elections folks in Fredericton and Saint John and the
following three folks amongst many others to explain why I find this
necessary for me to do so. Dan Robichaud 506-636-7094, Michelle Hooton

actions explained to them and does not trust my words and deeds
perhaps they should ask of me to the President of the NDP, Pat
Hannratty, or Greg Byrne, the President of the Liberals or the little
Lord himself after they read the text of the following letter.
        Here is hoping some Proud Canadians like me read on, check my
work and then challenge my ethics and that of all the other smiling
bastards as well. In the end I will be still smiling. You can take
that to the Federal Reserve Bank after some Yankees check the work of
the SEC and George W. Bush. The buck does stop there. The Holy See is
praying that it don't. Ask me why I Double Dog Dare ya. Better yet ask
Whitey Bulger if you can find him. His dwarf of a brother ain't saying
nothing. He took the fifth a long time ago.
I am not speaking in riddles. My matters are very complicated that s
all. Blame lawyers not me for that fact. The dudes in the FBI that are
receiving this email know exactly what I am talking about and so does
the Suffolk county Assistant District attorney Alicia S. McDonnell and
all her political bosses. The nasty Yankee ADA keeps on trying to call
me crazy. Yet she knows for certain I am only crazy like a fox.
Malevolent Yankee lawyers look like chickens to the pigheaded mangey
old dog of a Maritimer that is me. I now have the proof i required of
her friend Judge Hanlon's malice. I needed it to sue the Crown.

enclosed to anyone that wishes to read the documents. We are all part
of the same democracy and should share the same concerns about those
who are charged with upholding the public trust. Whereas I cannot
afford to trust anyone these days I have mailed this letter to
Conacher today and I will serve the other in person tomorrow to the
office of the Commission on Legislative Democracy before I Meet with
the Police Commission. I am concerned that my adversaries my try to
use some sort of Lieutenant-Governor’s warrant against me in order to
stop my legitimate defence of my family’s interests and rights.
The following are the words of Ms. Castonguay. I have been as brief as
possible because the documents and the CD speak for themselves. "The
New Brunswick government has a responsibility to listen to the people.
The Commission will receive briefs from the public and will make
recommendations to the government concerning the democratic process.
Its mandate is broad and will make it possible to gather people’s
ideas and concerns. For me, this work is important because it directly
affects the people of New Brunswick ."
I find that the Commission has a very questionable mandate when it is
to report to only one man. Although I agree with Mr. Lamrock’s
statements about this, his words don’t ring true in light of the fact
that he shares his office with T. J. Burke, another lawyer that I did
serve this material upon the day I was banned from the legislature
building. I did inform Mr. Lamrock of this material’s existence and in
his associate’s possession. He has had a lot to say to everyone about
many things but nothing at all to say to me. The same holds true for
Duff Conacher. He and I have crossed paths many times in the past. The
doings between Howard Wilson and I should have caused him to sit up
and pay attention. However I only received a call from his office just
once after I had had a little talk with the folks at The Hill Times
about Aaron Freeman and Ralph Nader. Now I see that Freeman is no
longer a Board member of Democracy Watch.
I find both of your organizations very interesting to say the least.
Please make no mistake, I am stress testing your ethics to the max
before I return to the USA and argue Mr. Ashcroft’s cohorts. I am
truly in the pursuit of friends not foes but I will welcome any
argument from a lawyer that refuses to uphold the law. I have made it
well known that I find our country to be in an absolutely disgraceful
state and that it has been brought upon us by the work of many a
corrupt lawyer. That is the reason many fellow Canadians such as I
have never voted. It is time for a change. All that needs to be done
to rectify the situation is to make certain that the laws that already
exist are upheld and the ones who break them are held accountable.
Any layman can glance at these documents and easily see that I have
worked very hard to put many a low man in high places in two countries
in a very big fix. Someone must be diligent and ethical if lawyers
refuse to act in such a fashion. This is no conspiracy theory. It is
evidence of irrefutable facts. It is just the tip of the iceberg.
There is much more to tell but this is enough to ask the simple
question. What say you?
I ask that Lynne Castonguay and Duff Conacher study this material
closely. I have provided it to them at considerable effort and
expense. This material does fall well within the realms of their
stated concerns about our democracy. If they do not provide me an
answer to this letter in writing, I will consider them to be part of
the problem rather than the cure. If nothing else I may call them to
testify in a court and before a jury of my peers. I will expect them
to tell the truth, the whole truth and nothing but the truth, so help
them their god.
