Police officer heading to public hearing over messages revealed at Dunphy inquiry

Const. Joe Smyth discontinues court application to halt proceedings

Police and Public Trust, a CBC News Atlantic investigative unit project, scrutinizes the largely off-limits police complaint and discipline systems across the region. Journalists are using access-to-information laws, and in some cases court challenges, to obtain discipline records and data.

A Royal Newfoundland Constabulary officer has chosen to head straight to a public complaints commission hearing in relation to text messages described as "inappropriate," and has dropped a court application intended to delay proceedings.

Const. Joe Smyth's lawyer, Jerome Kennedy, emailed Justice Peter Browne on Monday afternoon, after CBC News published a story on Smyth and Staff Sgt. Tim Buckle's applications before the Supreme Court.

The duo had applied for judicial review of decisions made by the interim RNC public complaints commissioner Augustine Bruce, to send Buckle and Smyth to two separate public hearings. 

"This complaint has been ongoing for years and he wishes to have it dealt with," Kennedy wrote in the email, which was sent to the RNC public complaints commission and complainant, Andrew Abbass. Abbass provided it to CBC News. 

Supreme Court officials confirmed a notice of abandonment was filed on Tuesday.

That clears the way for Smyth's public hearing to proceed on Dec. 13 and 14.

Kennedy and James Strickland, lawyer for the complaints commission, had made arguments on Kennedy's stay application in September. Browne had not yet delivered his decision. 

Smyth is alleged to have conducted himself in a manner unbecoming to a police officer and bringing discredit upon the Royal Newfoundland Constabulary in relation to text messages with now-retired Staff Sgt. Tim Buckle. 

In those messages, Smyth called Abbass a "loser" after Buckle, a friend and long-time colleague, told him that Abbass was arrested under the Mental Health Care and Treatment Act. Abbass was taken to Western Memorial Regional Hospital in the days after Smyth shot and killed a civilian in the civilian's home in 2015.

Abbass, however, did not file complaints with the RNC until the messages were revealed during the public inquiry into the death of Don Dunphy two years later.

Smyth shot Dunphy at his home in Mitchell's Brook, 45 minutes outside of St. John's, on Easter Sunday 2015, after Smyth said Dunphy raised a rifle at him. The member of then-premier Paul Davis's security detail was there because of tweets Dunphy had sent, which were also deemed threatening in nature.

The inquiry absolved Smyth of any wrongdoing and determined that he responded with the correct use of force in self defence. 

The messages were sent after Abbass was illegally detained because of a tweet which was deemed threatening.

In 2015, he sent tweets to Premier Paul Davis. Soon later, the police were at his door. Now, more than 8 years later, what happened to Andrew Abbass could be the subject of a public hearing. The CBC’s Ariana Kelland explains.

The complaints were investigated by the RNC's professional standards division. Now-retired chief Joe Boland concluded Smyth's messages with Buckle were private, and did not amount to a contravention of the RNC Act, which governs the force.

Now-retired deputy chief Ed Oates delivered a report in 2021 in relation to Buckle's involvement in the detainment as well as other issues identified by the force. He concluded Buckle would have been fired, had he not already retired.

Abbass appealed both decisions — which only become public when Abbass posted the information on social media. 

Bruce, interim commissioner of the RNC public complaints commission, reviewed the decisions by Oates and Boland, and in October 2022, dismissed some elements of Abbass's complaints and referred others to a public hearing — a rare quasi-court proceeding to determine an officer's guilt or innocence in relation to their duties as a police officer.

A month after that ruling, Buckle's lawyer, Bern Coffey, filed an application arguing for judicial review. He said Bruce did not explicitly say which parts of Abbass's complaint would be subject to a hearing.

Coffey also said Bruce conflated the RNC's detention of Abbass under the Mental Health Care and Treatment Act with an appeal court's ruling that Abbass ought to have had his arguments over his detention heard in court.

Like Coffey, Kennedy argued Bruce failed to outline which evidence the deputy chief and chief failed to consider in their investigations and subsequent reports, and that he didn't provide sufficient reasons for the public hearing.

The RNC Act says a retired officer can be dealt with in a public hearing as if they are still an active member of the force. However, it's unclear what discipline could potentially be imposed.

"Hiscock is a member of the Ad Hoc Coalition for Civil Liberties and spoke at the inquiry during a panel discussion called "Protecting Freedom of Expression in an age of Social Media."

"What is going to result in police showing up at your door? There wasn't a good reason to visit Dunphy," he said.

Hiscock fears the line between what is acceptable and what isn't has moved but he said he has a firm view on when police should investigate social media posts.

"Police are the best people to do threat assessment but perhaps the worst to address a grievance like Dunphy's. When should police investigate? I think the line should be that it is a criminal threat," said Hiscock.

"Public officials should be safe but people should be able to make as many nasty comments as they want, as long as they are not threats."

Another member of the ad hoc group, Ed Hollett, said government organizations and others should re-consider how they handle social media that is possibly threatening or raises concerns."

He was detained by police after sending a tweet. 8 years later, he's fighting for a public hearing

Andrew Abbass is seeking accountability in a public forum for the actions of RNC officers

Police and Public Trust, a CBC News Atlantic investigative unit project, scrutinizes the largely off-limits police complaint and discipline systems across the region. Journalists are using access-to-information laws, and in some cases court challenges, to obtain discipline records and data.

A man who was illegally detained by the Royal Newfoundland Constabulary and housed for six days at a psychiatric unit against his will in 2015 is determined to bring his case to a public hearing. 

But the police officers at the centre of the complaints have gone to court to stop that from happening.

Andrew Abbass filed public complaints against the now-retired Staff Sgt. Tim Buckle and Const. Joe Smyth in 2017, when new information surfaced during an unrelated police shooting inquiry.

After numerous years, reports and appeals, the acting commissioner with the RNC police complaints commission has sent the matter to a public hearing.

However, even that is in limbo, as both officers have applied to the Supreme Court of Newfoundland and Labrador for judicial review.

"At the end of the day, no one has been found to be fully accountable in any meaningful way," said Abbass, 42, in a recent interview at his home in Happy Valley-Goose Bay. 

"I wouldn't be able to sleep. As stressful as it is, I kind of feel like I'm on the right path. It's the path I was forced to take, but it's still the one I'm supposed to take."

It's been eight years since the alleged misconduct happened. Both Abbass and an expert in police discipline say the process against the two officers has dragged on far too long and speaks to the need for deep reform on police complaints procedures.

It's expected there will be two separate hearings. Smyth's public hearing — should it proceed — will focus on private BlackBerry messages between he and Buckle after Abbass was detained. The hearing for Buckle, meanwhile, will examine Abbass's detainment and the events that followed. 

Political commentary

Abbass first came to the RNC's attention in Corner Brook in 2014, when he attempted to charge then prime minister Stephen Harper and his foreign affairs minister for "inciting genocide by the state of Israel against the Palestinian people." 

Abbass had applied to the Supreme Court of Newfoundland and Labrador to hear his argument. The federal government issued a response, but a judge ultimately declined to hear the case in 2017.

"I was trying to spark a conversation," Abbass explained.

Then, on April 5, 2015 — Easter Sunday —  Smyth, a member of the premier's security detail, shot and killed Don Dunphy in his home in Mitchell's Brook, about 45 minutes outside St. John's.

Dunphy was an injured worker who often strongly criticized the province's workers' compensation system online.

Smyth, investigating a tweet sent by Dunphy that was interpreted as a threat, said Dunphy pointed a firearm at him.

Abbass saw the two incidents as interconnected examples of government overreach, and made his feelings known on social media the following day.

"They were so paranoid. They were looking at everything without checks and balances in place to ensure someone isn't just misreading somebody else's intention," he said. "That's how it ended up happening."

Abbass said he heard an interview with the premier on CBC Radio, in which he said there would be a cracking down of social media monitoring in the wake of Dunphy's shooting. He saw that as Davis doubling down, and considered it an affront to free speech.

Abbass tweeted: "How about this, premier of N.L.: I'm going to bring down Confederation and have politicians executed. Ready to have me shot, coward?"

The tweet, he admits, was meant to antagonize.

"I figured they would arrest me."

Four RNC officers came to Abbass's home in Corner Brook where he was living with his pregnant girlfriend and detained him under the Mental Health Care and Treatment Act.

Despite spending the next six days in the psychiatric ward of the Western Memorial Regional Hospital in Corner Brook, Abbass was never charged with a crime. Nor was he certified as suffering from any psychiatric condition. 

"The six days were like a vacation compared to what came after. The six days was sitting, drinking tea and talking to people, wondering what's going to happen next," Abbass said.

"At the end of the day, nothing was lawful. Everything that was done to me never should have happened, so everything that has happened since then, this is the fruit of the poison seed. This is the tree that grew and there's no indication that anyone wants to address that yet."

In the wake of Abbass's arrest, the RCMP got a warrant to search his home over a tweet they viewed as potentially threatening against Stephen Harper. The tweet was sent before the Dunphy shooting, but the Mounties moved in only after he was detained by the RNC. He was charged with uttering threats but it was dropped soon after, at his first court appearance.

However, once inside his home, they discovered marijuana and charged Abbass and his pregnant partner with cultivation. Abbass said he used it for medical reasons but didn't have a licence at the time.

A judge gave him an absolute discharge.

Complaints against 2 RNC officers may soon go to a public hearing — nearly a decade after the alleged misconduct

Two years later, Abbass would get vindication in another courtroom. The Newfoundland and Labrador Court of Appeal issued a ringing defence of political dissent, and found that a lower-court judge was wrong to dismiss Abbass's application to challenge his detention.

"If anger about political events and words of defiance to authorities are dealt with as signs of mental illness, a priori mental illness warranting involuntary committal, then our society is in a dangerous place," the three-judge panel wrote in a unanimous decision. It included Justice Malcolm Rowe, who has since been elevated to the Supreme Court of Canada.

"Such anger and defiance are characteristic of political dissent. As the history of authoritarian societies has taught us, confinement in a mental institution is a particularly insidious way of stifling dissent, directly and through intimidation."

But Abbass said he wasn't aware of the backstory of how he came to be detained until an inquiry into Dunphy's death. It was a high-profile public spectacle that ended in Smyth's exoneration, exposing private correspondence along the way.

That included this series of BlackBerry messages, sent on April 7, 2015 — entered as evidence at the inquiry, and now subject to the upcoming public hearings:

"I'm not saying it's acceptable," Buckle told the inquiry at the time. "Sometimes in private conversations we use unacceptable language."

The inquiry also saw an email Buckle sent to all staff of the RNC urging caution when responding to calls about Abbass because he was active on Twitter in the wake of Dunphy's death. Buckle referenced Abbass's filing of complaints about the federal government's involvement in the Israeli and Palestinian conflict.

The email was forwarded from Smyth to another officer within the premier's security detail with the words: "same thing brother."

Abbass said the email was not warranted and he believes it laid the groundwork for his detention the following day. 

He filed two complaints with the RNC public complaints commission after learning about the messages during the public inquiry.

Then chief Joe Boland dismissed Abbass's complaint in 2017. He said the text messages were private and did not support a conclusion that the officers were trying to harass Abbass.

Boland said the officers did not breach the RNC Act but echoed comments from Don Dunphy inquiry commissioner Leo Barry, who found that the messages between Buckle and Smyth demonstrate that the RNC does not have a culture of "compassion and respect for all citizens."

Abbass appealed.

Detention 'serious and wrongful deprivation' of rights: report

second report by then RNC Deputy Chief Ed Oates, which was made public by Abbass himself, spelled out a history of complaints and troubling behaviour by an officer only referred to as Officer X. The officer is Buckle.

Oates called the detention a "serious and wrongful deprivation" of Abbass's liberties stemming from a police officer's abuse of authority.

Oates determined Buckle would have been fired had he not retired first. He said there was nothing that could be done because he was no longer with the force.

Again, Abbass appealed. 

"You have an officer who abused his authority and I think there needs to be a clear message sent that that kind of thing is not acceptable and that kind of thing damages the public's faith in policing," said Abbass.

"If it's not punished properly then it sends the worst kind of message — that it's acceptable and people can get away with those kinds of things."

Abbass said the decision only intensified his resolve to push for a public hearing.

Augustine Bruce, interim commissioner of the RNC public complaints commission, reviewed the decisions by Oates and Boland, and in October 2022, it appeared Abbass would get his wish.

Bruce dismissed some elements of Abbass's complaints and referred others to a public hearing — a rare quasi-court proceeding to determine an officer's guilt or innocence in relation to their duties as a police officer. 

A month after that ruling, Buckle's lawyer, Bern Coffey, filed an application arguing for judicial review. He said Bruce did not explicitly say which parts of Abbass's complaint would be subject to a hearing.

Coffey also said Bruce conflated the RNC's detention of Abbass under the Mental Health Care and Treatment Act with the appeal court's ruling that Abbass ought to have had his arguments over his detention heard in court. 

Smyth, who is represented by Jerome Kennedy, has also applied for a judicial review as well as stay of the public hearing, until the review can be completed.

Like Coffey, Kennedy argued Bruce failed to outline which evidence the deputy chief and chief failed to consider in their investigations and subsequent reports, and that he didn't provide sufficient reasons for the public hearing. 

A decision on the stay of proceedings is expected in several weeks. 

Asked for additional comment by CBC News, Coffey referred to the judicial review before the Supreme Court and the public complaint before an adjudicator.

Kennedy did not respond. 

The RNC Act says a retired officer can be dealt with in a public hearing as if they are still an active member of the force. However, it's unclear what discipline can be imposed.

Quicker investigations necessary, says prof

Temitope Oriola, a criminology professor at the University of Alberta, says internal cases against police officers should be completed within a year, in order to maintain public trust. 

Oriola helped shape legislation on police oversight and was named special advisor to the Alberta government on its review of that province's police act in 2021.

"It is too long, it is too costly and it serves seemingly to frustrate individuals who would dare to try," said Oriola.

"Positive engagement cannot be there when it takes nearly a decade to hold a couple of police officers accountable."

Some of the delays in this case can be attributed to a number of other criminal and judicial matters that unfolded at the same time. The RNC Act says any investigation of a police officer must be paused while other court matters are heard first. 

In this case, that would include a criminal investigation of Buckle by the Alberta Serious Incident Response Team — the details of which were never made public, with charges never laid — and Abbass's matter before the provincial Court of Appeal.

The RNC Act is from 1992, and Oriola says police legislation needs to be updated with the times.

"The law must always be a living, breathing organism, one that grows and evolves as a society evolves," he said. "When that does not happen, society begins to play catch-up."

Newfoundland and Labrador is not alone in this, he said, but the onus is on elected leaders to ensure laws and policies are updated regularly.

Oriola began researching police misconduct under the lens of excessive force but said he believes the text messages between Buckle and Smyth should not be downplayed in the broader spectrum of possible wrongdoing.  

"For better or worse, such communication, however seemingly private, is evident of perspective and orientation, the attitudes that people bring to their jobs and of course to their decision-making process," said Oriola.

"Why do we form such protective rings around the individuals who are soiling what seems to me … the reputation of police service?"

Oriola said the case highlights the inherent risks when the mental health act is applied in haste. 

Abbass wants to see legislative change to the Mental Health Care and Treatment Act in relation to the checks and balances that are required for detainment.

Abbass says he's not satisfied with some aspects of the commission's probe and believes it could have gone further, or been sent back for another police investigation. 

The text messages revealed at the inquiry were discovered on second look by widening the search dates. Abbass believes the time and date stamp was altered, although previous reports say there was no information to suggest wrongdoing.

He's also frustrated that he was never given a copy of the findings of the criminal investigation of Buckle, and whether charges were recommended to the province's director of public prosecutions. Charges were never laid.

For now, he said, public hearings — if and when they happen — are better than nothing at all. 

"At least to get people asking questions about what's going on and why this culture of impunity exists in our police force, because it doesn't seem like it's helping the public's faith in policing in the province," Abbass said.

"The RNC as an organization structure, I don't have a lot of faith."

People posting here can be so self-contradictory. How in the world can it be right for police officers to arrest and detain someone for a tweet, but at the same time wrong to limit our freedom of speech? I don't believe they arrested him for the tweets

I suspect (think...not know) that he was arrested under the Mental Health Act as a potential "danger to self or others"

and where I live (BC) that requires the "patient" (not prisoner) be delivered "without undue delay" to a Physician/NP for evaluation of their mental status

so no sitting in cells...straight to hospital

and that sets a very low bar

but when the police find some old guy wearing 4 sweaters and a parka shivering on the street corner in 40C weather

that low bar of "this is just weird"

can save a life

(in my example hypothyroid)

asking the police to rule out all the various causes of "strange" behaviour (which are actually responsible for over 60% of acute psychiatric admissions)

is asking a lot

Father of Labrador man illegally detained by police speaks out about 'a very long 6 years'

Leo Abbass wants the Department of Justice to look into the illegal detainment of his son, Andrew

The father of a Labrador man illegally detained by police for a series of tweets about the 2015 fatal police shooting of Don Dunphy is calling on the Department of Justice and Public Safety to examine his son's case.

Andrew Abbass's father, Leo Abbass, said a report detailing the findings of the investigation confirms what his son has been saying since his 2015 detainment.

"He's been trying to find closure," Leo Abbass said in an interview with CBC Radio's Newfoundland Morning. "Get this put to bed and move on with his life, but it's been difficult."

A recent investigation by the Royal Newfoundland Constabulary Public Complaints Commission found that an RNC officer abused his power when he arrested Andrew Abbass and took him to hospital against his will under the Mental Health Care and Treatment Act.

The report, written by retired deputy chief Edmund Oates, refers to retired RNC sergeant Tim Buckle as "Officer X." CBC News has confirmed Buckle's identity based on specific details in the report. 

The investigation follows a 2018 Supreme Court of Newfoundland and Labrador ruling that Andrew Abbass was unlawfully detained.

Abbass said former RNC chief Joe Boland has called his son to apologize, but he believes that the provincial government needs to weigh in on the incident.

"It was under their watch that this particular officer took the action that he took that, you know, had Andrew detained and his name smeared," Abbass said. "It's been a long six years."

Andrew Abbass has declined CBC's request for an interview. 

Leo Abbass said that for years his son has been trying to get justice officials to examine his case to no avail, but he hopes the release of the report will lead to action.

A statement from the Department of Justice said the matter is still open for appeal and no one would comment on ongoing legal matters. The statement also noted that the RNC Public Complaints Commission functions independently of both the Department of Justice and the RNC.

"I know Andrew would like to see some changes in legislature that ensures that what happened to him doesn't happen to anyone else again in the future," Abbass said.

Critical tweets

Abbass's detention happened on April 7, 2015, two days after RNC Const. Joe Smyth fatally shot Don Dunphy.

Smyth, who was at that time a member of a police unit charged with protecting the premier, travelled alone to Dunphy's home in Mitchells Brook, St. Mary's Bay, to inquire about tweets Dunphy had posted, which named then premier Paul Davis and another politician.

The visit ended in the fatal shooting of Dunphy. An inquiry into the shooting concluded that Smyth's use of lethal force against Dunphy was justified, because Smyth was acting in self-defence. Smyth said Dunphy threatened him with a rifle.

"He saw ... what happened to this gentleman in Newfoundland, Mr. Dunphy, and it bothered him that, you know, on Easter Sunday a man could be shot to death in his own home," Leo Abbass said.

After the shooting, Andrew Abbass, who was living in Corner Brook at the time, posted a series of tweets regarding the shooting that were critical of the police and Davis.

Buckle, who was friends with Smyth and frequently communicated with him over BlackBerry Messenger, opened an investigation of uttering threats after Abbass posted this tweet on April 7:

"How about this, premier of NL: I'm going to bring down Confederation and have politicians executed. Ready to have me shot, coward?"

Hours after posting the tweet, officers went to Abbass's home and detained him for a psychiatric assessment. 

According to the report, the psychiatric assessment concluded Andrew Abbass did not have a mental disorder and was not a danger to himself or others.

Abuse of power

The complaints commission report concluded that Buckle would be fired for abusing his power if he hadn't already retired from the RNC.

Abbass filed his complaint about the RNC after learning about a BlackBerry Messenger exchange between Buckle and Smyth entered as evidence in the inquiry into Dunphy's death.

The two officers exchanged these messages after Abbass's detainment:

Buckle:"Arrested Abbass under MHCTA [Mental Health Care and Treatment Act]."

Smyth:"Saw that! Nice."

Buckle:"He's at hospital now."

Smyth:"Loser."

Buckle:"Yup."

Andrew Abbass's complaint names Smyth as well as Buckle, but in a separate report, Oates concluded the allegations against Smyth were not proven on the "balance of probabilities."

Oates said Buckle was motivated by his "desire to protect and assist his best friend [Smyth] in the wake of the Dunphy shooting regardless of the illegality, abuse of authority or defamation of character that assisting and protecting [Smyth] would or might entail."

According to Oates, Buckle was able to direct RNC officers to carry out Abbass's detention without questioning his orders by creating a toxic work environment of bullying, intimidation and inappropriate sexual comments. 

Leo Abbass said he believes the Justice Department needs to scrutinize why Buckle was able to detain his son under mental health legislation. He said his son's rights were denied.

"You know, we don't expect this to happen here in our country and in our province," he said.

Leo Abbass said his son has experienced personal hardships as a result of the detainment, and has been "adamant" about following up on the investigation. 

"If somebody wanted to come and speak to him, you know, proper channels should have been done," Leo Abbass said. "It's what resulted afterwards, that … runs afoul to what we believe are our rights and the way we should be treated under the law."

Lawyer William Hiscock says police should only investigate if they believe a criminal threat was made

A lawyer speaking at a police shooting inquiry fears police investigation of Don Dunphy's tweets has resulted in people censoring themselves on social media in Newfoundland and Labrador.

Dunphy, 58, was fatally shot by Royal Newfoundland Constabulary Const. Joe Smyth, 38, on April 5, 2015.

Smyth said he fired four times after Dunphy pulled a gun on him. He was at Dunphy's home to speak with him about his twitter posts that named politicians, including then-premier Paul Davis.

Dunphy was an injured worker who often strongly criticized the province's workers compensation system.
 
Lawyer William Hiscock said Thursday that the incident changed many people's perceptions of how police do their work.

"Prior to the incident many of us believed that police only investigate if there appears to be a threat. Where is the line?" he asked.

"The chilling effect is more pervasive when we don't know where that line is."

Hiscock is a member of the Ad Hoc Coalition for Civil Liberties and spoke at the inquiry during a panel discussion called "Protecting Freedom of Expression in an age of Social Media."

"What is going to result in police showing up at your door? There wasn't a good reason to visit Dunphy," he said.

Line should be criminal threat

Hiscock fears the line between what is acceptable and what isn't has moved but he said he has a firm view on when police should investigate social media posts.

"Police are the best people to do threat assessment but perhaps the worst to address a grievance like Dunphy's. When should police investigate? I think the line should be that it is a criminal threat," said Hiscock.

"Public officials should be safe but people should be able to make as many nasty comments as they want, as long as they are not threats."

Another member of the ad hoc group, Ed Hollett, said government organizations and others should re-consider how they handle social media that is possibly threatening or raises concerns.

Hollett suggested such posts should be filtered through senior members of an organization before they are passed to police.

The inquiry led by Judge Leo Barry began hearings on Jan. 9. More than 50 witnesses have testified. The last witness, a police officer who provides protective services in Ontario, is expected to testify Friday.

It’s been 922 days since Andrew Abbass was picked up at his home and taken by police to Western Memorial Regional Hospital in Corner Brook for a six-day involuntary stay under the auspices of the Mental Health Care and Treatment Act (MHCTA).

It’s been six months since the Newfoundland and Labrador Court of Appeal acknowledged that Abbass should have been allowed to argue in court at the time of his detainment that he was being held unlawfully; in other words, that he should have been granted a habeas corpus hearing.

It’s been three months since he was finally granted that hearing and Justice Brian F. Furey heard the case, but the judge still hasn’t rendered his decision.

And so Abbass lives with the taint of that involuntary detainment clinging to him like a shadow; it has infiltrated every aspect of his life.

Of course, he can never get those six days of lost liberty back — six days during which he says he never received a thorough psychiatric assessment until well after he was admitted, was never diagnosed with a mental illness, was given no medication apart from a nicotine patch, and was not presented with any documentation from the police justifying his apprehension in the first place.

It all started with some edgy and emotion-charged tweets on social media. Abbass had been expressing his shock and anger at hearing that Donald Dunphy had been shot to death by a Royal Newfoundland Constabulary officer at his home in Mitchell’s Brook after sending his own impassioned tweets criticizing unfeeling politicians and a system that he felt had let him down as an injured worker.
“I think, in the aftermath of Mr. Dunphy’s shooting, I was one of the first people to speak up and question, and to say, ‘This stinks!’” Abbass told me in a May 2017 interview. “The police, the government, were uncomfortable with what I was saying.”

Abbass said when he asked one of the police officers who showed up at his door on that day in April 2015 why he was being hospitalized against his will, the officer said, “Look, I’m just doing my job.”

Abbass said he recalls thinking there were probably Nazi guards rounding up Jews and other vulnerable people during the Second World War who said the same.

And so Abbass lives with the taint of that involuntary detainment clinging to him like a shadow; it has infiltrated every aspect of his life.

He had hoped to have had a ruling in his habeas corpus hearing by now — with a decision in his favour — so that he could start trying to undo the impact the detainment has had on his life.

“There’s still a paper trail out there,” he says. ‘That’s not expunged in a day. I’m still in legal limbo, two-and-a-half years later.”

Abbass’s involuntary hospital stay has left him stigmatized, and has affected every aspect of his life — work, home, family, finances.

“There’s been a lot of stress and strain,” says the quiet-spoken, articulate 36-year-old, who had previously worked in the field of electronics engineering technology.

He’s living in Happy Valley-Goose Bay now, working as a computer technician and living paycheque to paycheque, trying to pay down his bills and raise his two-year-old boy.

“I’m just trying to work as much as I can and take care of my son. That’s as far as I can look right now,” he said.

“It’s disturbing that this happened to me. I should’ve had a hearing from the get-go. … I think the system’s become a little detached. There’s a difference between doing your job and ticking off boxes; these just aren’t boxes you’re ticking off. There’s a person in that box.”

Abbass said citizens of Newfoundland and Labrador should be concerned about the amount of power that can be wielded and potentially abused under mental health care legislation.

“You’re just giving them bigger and bigger hammers with the law,” he says, “and if everyone’s a nail, then a lot more people are going to get smacked down.”

January 12 is always a solemn anniversary in New Brunswick, since a
bus crash killed seven members of the Bathurst High School basketball
team and the coach's wife when their van collided with a transport
truck. Since that day, family members, and those who support them,
have pushed for change in New Brunswick.

Isabelle Hains, mother of victim Daniel Hains, passed on nearly 2,000
questions to a Crown prosecutor during the 2009 inquest into the
tragedy. Families couldn't get standing at the coroner’s inquest,
leaving many of their questions unanswered - something she says still
hasn't changed.

Hains' group, 'Van Angels,' has fought for the government to update
the New Brunswick Coroners Act, and she still remembers feeling shut
out of the Bathurst inquest whenever she sees another family in the
same situation.

“I just feel for them, I say, ‘Oh my gosh, if they only knew what they
have to go through to get the answers they want,’” says Hains.

“It's unbelievable that we're still dealing with a Coroner's Act that
doesn't do so many things for the living and for the dead,” says Van
Angels member Melynda Jarratt. “If its aim is to protect the living, I
don't think it achieves its goal.”

David O'Brien, a past president of New Brunswick Bar Association, has
spent more than a decade pushing for an overhaul of the New Brunswick
Coroners Act, fighting to give families and other groups legal
standing when it comes to coroner's inquests.

“I think we should take another kick at the can,” says O'Brien. “We're
the only jurisdiction in the country that does not permit that. All
other jurisdictions have agreed it's a good idea and implemented it,
some of them, like Ontario, as long ago as the 1970s.”

Legal standing gives interested parties the right to hire their own
lawyers, call witnesses, and ask questions during an inquest.

“It comes from a different perspective if you have members of the
family who can ask their own questions rather than having to pass
notes to a Crown prosecutor,” says O'Brien.

Hains and Jarratt believe acts adopted by other provinces are more effective.

Moncton native Ashley Smith was the subject of an inquiry after her
2007 death in an Ontario jail.

Her family was able to gain legal standing in Ontario and participate
in two inquests, which lawyers say was vital in obtaining the eventual
verdict of homicide, rather than an accident.

In the years since the Smith inquiry, there are numerous examples of
families fighting and failing to obtain legal standing in New
Brunswick inquests - from the Serena Perry case in Saint John to the
October inquest into the death of Dorchester inmate Glen Edward
Wareham.

“2003, 2008, 2009, 2011, and I wrote the last letter in 2013 to
whoever was in power in 2013!” says O'Brien. “Liberals, Conservatives,
we never really got a principled response as to why they declined to
do what's been done everywhere else in the country.”

The Bar Association hasn't requested that the Gallant government
update the act, but feel change needs to come soon.

The Department of Justice and Public Safety did not respond to CTV's
request for comment on Thursday.

Education and Early Childhood Development says it's still possible the
libraries up for closure could stay open.

Kirby said Monday that some of the Newfoundland and Labrador Public
Libraries branches are in a location that could allow for an easy
transition for the municipal government to take them over.

He also said that a number of public libraries that are in schools may
not close.

Kirby said after funding from the provincial library board is cut,
schools may chose to keep those libraries open, although he said they
will no longer be accessible to the public.

"People have the misconception that school libraries are closing and
that's not true," said Kirby.

Last week, the province announced funding to  54 of the province's 95
libraries is going to be cut.

Of the 54 libraries the province has up on the chopping block, 25 of
them are within municipal buildings. In those cases, the towns could
take over the operation and cost of the libraries.

Another 20 are within schools in the communities,

The remaining nine are in stand-alone buildings.

Over the weekend, Liberal backbencher Scott Reid suggested on Facebook
that the government should reconsider public library cuts.

Speaking with reporters Monday, Kirby said that will not happen.

"The budget is not going to be reconsidered," he said.

"What's in the budget is in the budget — that's my understanding.
Education and Early Childhood Development's budget is not under
reconsideration."

According to Kirby, the Newfoundland and Labrador English School
District will work with local groups to provide public access at 20
school libraries.

Kirby added the province has twice the number of libraries per capita,
but half the funding, than other jurisdictions.

He said the library cuts are a "devolution exercise" more than closures.

Kirby added none of the decisions for his department outlined in the
2016 budget will be changed.
