Interim ethics commissioner with family ties to minister steps down
Martine Richard will stay on in a senior role in the ethics commissioner's office
Martine Richard was appointed to the role in March for what was supposed to be a period of six months. The last commissioner, Mario Dion, retired in February.
But Richard has stepped away from the role she was appointed to only weeks ago, according to a press release from the ethics commissioner's office released on Wednesday.
"Martine Richard has informed the Privy Council Office (PCO) that she will no longer be serving as interim commissioner," the statement said.
Richard is the sister-in-law of Intergovernmental Affairs Minister Dominic LeBlanc and her appointment caused an uproar among the opposition parties, particularly the Conservatives.
Conservative MPs questioned Richard's appointment, pointing out that a number of Liberal MPs — including LeBlanc — have run afoul of ethics rules in the past.
Liberals defended the appointment, saying Richard has held a senior position in the ethics commissioner's office for years and was hired when Stephen Harper was prime minister.
On Tuesday, the committee on access to information, privacy and ethics agreed to study Richard's appointment over the course of three hearings, and to invite her and LeBlanc to testify.
Wednesday's statement said Richard will stay on in a senior position with the commissioner's office.

Values and Ethics Commissioner
Diane Girard was appointed as the Corporation’s first Values and
Ethics Commissioner on September 19th, 2016. Her role is to provide
employees with guidance and support on ethics matters, be a point of
contact for concerns and complaints regarding the Code of Conduct and
related policies, as well as develop and manage the Corporation’s
ethics program. Before her nomination as Commissioner,
Ms. Girard practised as an ethics consultant for organizations from
the public, private and professional sectors for 20 years. Prior to
that, as a trained lawyer, she practised labour law for many years.
A recognized authority in the field of organizational ethics, she has
published numerous book chapters and articles in such journals as
Gestion and Éthique publique. She also conducted a two year study on
practices in organizational ethics in Québec, with 107 participant
organizations of the private, public and health sectors.
Helping managers and employees develop their ethical leadership and
capabilities has always been important for Ms. Girard, which is why
she lectured for 15 years in business and organizational ethics at
McGill University, and also taught similar courses at Laval University
and Université de Sherbrooke.
Ms. Girard holds a master’s degree in business administration (MBA), a
master’s degree in law and a postgraduate diploma in applied ethics.
She also completed a PhD in management and ethics at HEC Montréal.
She is the founder and past president of the Quebec Organizational
Ethics Network (RÉOQ). She sat on the board of the Ethics
Practitioners' Association of Canada (1999 -2003), and served as its
Quebec regional coordinator in a volunteer capacity for 13 years. She
also sat on the board of the Canadian Human Rights Foundation for a
few years
Mandate
CBC/Radio-Canada is Canada’s national public broadcaster and one of
its largest cultural institutions. In the fulfillment of this critical
role, the Corporation’s Code of Conduct and other related policies
(namely policies on Conflict of Interest, Anti-Discrimination and
Harassment, Political Activity, Disclosure of Wrongdoing, and Fraud
and Theft) outline the broad range of values, expected behaviours, and
standards of integrity and business conduct that guide employees at
all levels.
CBC/Radio-Canada has created the Values and Ethics Commissioner
position to nurture an ethical environment. The Commissioner is
neutral and independent. To ensure this independence and neutrality,
the Commissioner has a direct reporting line to the CEO.
The Commissioner’s mandate has three main components:
Advisory Role
The Commissioner provides information, advice and guidance to all
employees about their own situations and their concerns regarding
values and ethics, namely regarding the Code of Conduct and other
related policies governing ethical behaviour, other than the
Journalistic Standards and Practices.
The Commissioner is responsible for the development and management of
the Corporation’s ethics program. She also periodically evaluates the
ethical culture and climate of the organization, and makes
recommendations.
Educational Role
The Commissioner contributes to the development and implementation of
values and ethics training, providing opportunities for awareness and
learning regarding such topics as ethics responsibilities, ethical
issues and ethical decision-making.
Investigative Role
Concerns or complaints relating to values and ethics can be submitted
directly to the Commissioner’s office by employees. Other than those
relating to the Journalistic Standards and Practices. The Commissioner
also acts as the designated Senior Officer for the Corporation’s
Policy on the Disclosure of Wrongdoings (Whistleblower Policy).
She is also the point of contact for members of the public who have
reason to believe that a CBC/Radio-Canada employee is not complying
with our Code of Conduct or related policies, except for complaints
regarding the Journalistic Standards and Practices, which are covered
by the Ombudsmen.

You dudes from Quebec yap of sovereignty all day long then mouth your support of Harper’s attack on all our sovereignty just because he kicked your fancy French arses in the last election? Perhaps you should listen to the attachment in your next email before we meet in court.
Pursuant to my many phone calls and email to all of you over the years, you will find enclosed as I promised Hard Copy of exactly the same material sent to Allan Rock, Franky Boy McKenna and the FBI exactly one year ago and many others today. The true copy of the Yankee police surveillance wiretap tape #139 is served upon you as officers of the court in order that it may be investigated. Now that my family has been without their home and their father for almost a year everything I said to the crooked lawyers McKenna and Rock holds particularly true for all of you today. You people forgot we are human too. Do with your irrefutable knowledge of crime what you will in your own selfish best interests as I prepare to file my first complaint in Canada to defend my freedom and argue you in court.
The words in the above paragraphs were all that I was going to say to you people especially after all the times I have tried to make contact with you in the past. However the Conservatives were flying way too high in April for me not to try to shoot the government’s mandate down in May. I have been busy lining up liberal ducks that lost their positions in the last election to drag into court to embarrass Conservatives with. Derek Burney and Mulroney have ordered their puppet, Harper to dare the opposition to cause an election merely because he is temporarily higher in the polls. That is just like Humpty Dumpty did last fall. He got a great kick in the balls and suffered a great fall with that sort of thinking. C’est vrai?

"The Liberal Party is ""perfectly capable"" of fighting an election even without a new leader in place if the need arises, Interim Leader Bill Graham insisted Tuesday. Mr. Graham, appearing on CBC Newsworld dismissed suggestions that the party is stuck with the Conservative agenda in the coming session because it is not set to go back to the polls."
Graham while you trying to sprout some balls of your own this spring, I want you to know that Byron Prior read me the letter you pal Cotler wrote to him at your request after polling day was history in 2004. If the current Minister of Justice were an ethical man, he would have given a copy of Cotler’s letter long ago to the Speaker so that all Parliamentarians could have discussed the former Minister of Justice ethics and accountability. What say you? If anyone should pay attention to this letter it is the Bloc. I am trying to be fair even though Ms. Freeman’s snotty assistant threatened to throw my material in the trash. Andre Arthur and the Conservatives made the Bloc look like buffoons in the last election. Tonight is the Bloc’s big chance for payback if anyone in the Bloc has the sand to act ethically ASAP.
In the "mean" time why doesn’t somebody just do their job and call the liberal, Aldééa Landry or the lawyer, Marian McGrath, of the Security Intelligence Review Committee at 613 990-5866 to get the low down about what I am up too? They do report to Parliamentarians. N’est pas? Yea, I know it is a waste of time. You all must know of my concerns particularly with the budget vote ce soir or the new women in the Bloc camp, Freeman and Barbot, would have called me back months ago. N’est pas?
As I line up French ducks, I often think of you, Michael Fortier. I suspect you have heard my name cursed quite a bit lately. The fact that you were picked rather than elected to sit in the House as a Cabinet Minister by your pals Burney and Mulroney makes me curse you too. I well remember your smirk as the wicked Speech from the Throne became history on April 4th. I saw it just before Marion McGrath called me back and laughed at me. The memory of a bald evil looking lawyer who was with Mulroney’s law firm and the TD Bank too poking the tips of his fingers together with glee makes me see red a lot. The Frenchman can hear a trueconservative Maritimer curse a blue streak if he says my name in just the right company to his Newfy buddy the aptly named lawyer, Rob Moore. Methinks that little biblepounder could lose his cool and turn the air as blue as Humpty Dumpty’s balls.
Why bullshit each other? You all know I am the guy who has caused John Manley, Brian Tobin, Allan Rock and Franky Boy McKenna not to want to be the leader of the liberal party. Tobin worked for Magna and obviously McKenna got this material twice and Rock once thus far. Trust me I made certain that I could prove that John Manley should know much about my issues with Bankers and publicly held Corps. Furthermore I sent a lot of people an email and even posted it on the Internet within a blog or two the reason Belinda crossed the floor last year. Don Amos General Counsel and Paul Cellucci VP of Magna Entertainment know all about the many wiretap tapes etc and the evidence of other crimes I have. Quite frankly so does almost everybody else of political import in two countries for over three years. You are looking at the proof that on July 16th, 2002 I gave my material to the CBC and Paul Cellucci in Ottawa before I began to prosecute my first complaint in a Pro Se fashion in the USA. If you bother to notice I am doing the same thing now but in a far larger scale and that is after running for a seat in Parliament twice and studying a lot of law day and night for years. This ethical Maritimer and fierce political animal is ready and chomping at the bit to Raise a Lot of Hell. I will leave it to you to speculate as to whether or not I am successful. However I must inform you I have nothing left to lose. Thus legions of lawyers will find me one genuine pain in the ass in the near future. I am relying on the truth in the old saying that "there is no honour amongst thieves" so if the liberals and the Bloc were truly clever they would figure out some way to side with me quickly.
From my point of view whatever remains of the liberal party that emerges from its rumble for its own benefit should boot out all the lawyers that sat in the 37th, 38th and 39th Parliament. One thing that can be easily replaced is a lawyer or a politician. A political party’s reputation is very hard to regain.
Mulroney proved that for ya. Didn’t he? Every now and then Canadians
will slap most if not all the offenders of the pubic trust out of
office. History has proven that many times. Do you not think it will
repeat itself? Look at how many times Harper has proven he looks down on
Canadians with contempt even though he has only a minority government.
The fool has already proven to all what he really is. Why do the
opposition even hesitate if they were not as corrupt as he? I will do my
best to see that the Conservatives do not last long in power or my name
ain’t Dave. I think the key to Harper’s demise could still be a few
words from the MP Andre Arthur but someone else could still scoop him as
early as tonight and become a Canadian hero who may become a Prime
Minister someday.
Listen the portions of the wiretap tape in your email right now and remember that I gave nine wiretap tapes to the Suffolk county District Attorney in open court in September of 2004 and my lawyer gave nine original ones to Senator Arlen Specter on Feb 7th. Do you see Bush’s loss of support since then? I do. Interesting EH? Think fast. I have been getting some interesting calls for a change. I am not the only person on the planet who wants to see George W. Bush impeached ASAP. I have given up on my sense of ethical conduct and decided to give copies of wiretap tapes to anyone that wants them despite what law enforcement may wish to say about it.
I explained my reasons to Stevey Boy Harper and a bunch of bankers today. All Canadian and Yankee law enforcement authorities I have managed to speak to over the years falsely claim that they cannot address my own issues with me because it is a matter of public safety and must be kept secret. Bullshit.
The only people that could claim that my matters are
secret are the people in CISIS or the DHS. They are trying to protect is
their own nasty arses at the expense of mine. All the bureaucrats I
talk to lately appear to be lost. John Shuttle in the PCO office is for
example does not know who in his office Harper is going to can or hold
accountable. Two political bosses, Landslide Annie and Pierre Pettigrew
have slipped out the back and effected a getaway with a fine pensions..
Small wonder Stockwell Day and Petey Baby MacKay refuse to call me back.
EH? As always they are confused. Tis my turn to ignore all you
political lawyers for awhile and watch Harper government make ready for
its high diving act. I have no wish to speak to you now unless it is in a
very public fashion. None of the behind closed doors in confidence crap
for me anymore. The people of two countries and my little Clan in
particular have the right see my simple truths out in the open and
argued. To that end, I would prefer to question you in court under oath.
Thus consider yourselves notified that if I am ever allowed the due
process of law I will call you to testify. You can be a hostile witness
if you wish. In truth I think it would be more fun. I must find a way to
entertain ordinary folks like me because most Canadians are bored with
all the political shenanigans that you fools embrace.
If you have any questions about my matters before I call you to court to testify about what you have received, perhaps you should contact the women at SIRC or the CISIS people whose work they are supposed to check. I suspect that they will tell you what they know of me is a secret and a matter of public safety. Too bad so sad for you. Cry me a river about the reasons that you never bothered to call me back. I ain’t holding my breath waiting for a Fed to do their job anymore. I am suing the Crown.
Under the Charter I have the definite right to no false imprisonment in
another country supported with false allegations served upon me by my
own consulate while I sat in jail with no bail and held under the
charges of "Other". If Stevey Boy Harper or Paul Martin were I, they
would have sued the Crown the instant they came screaming out of jail.
Am I any less of a man than they are just because I am as poor as a
church mouse? I my book money does not make a man, his word does. You
dudes take oaths all the time. A man like me fails to see the need.
Should not everything one says in serious matters be true? Why the need
for an oath, especially when speaking for others for a fee?
You all work for the good of the common man in the House of Commons. EH? FYI, most of us common men know your secret. The doubletalk of mandates etc only serves to prove your dishonesty. The reason you will not act within the scope of your employment ain’t a matter of Public Safety at all. Rampant Public Corruption ain’t a closely guarded secret. It is common knowledge that is as old as man himself. It is my fondest wish to bring great shame upon the legal profession and all employed in law enforcement. You have all sworn oaths to uphold the law and delay and deny no one for lure or malice.
All have proven to me that you work hard
to do the opposite and betray the public trust for personal gain. For
my own protection and satisfaction, I have written a journal and secured
copies of it in many places with supporting evidence. Your names can be
found within. I cannot depend on justice being served in the purported
Democracy that stands in Canada right now or ever. You choose the part
you wish to play on the little stage I have set for you. I will record
the truth of your actions or inaction with the faith that sooner or
later the truth will be known about what I have managed to do.
Enough said, tis time for me to run to the UPS store. I cannot trust the Canada Post with this stuff. Afterwards I am going back to the woods and write something kinda important. Democracy Watch questions whether Ethics Commissioner’s senior lawyer is Liberal Cabinet Minister Dominic LeBlanc’s sister-in-law?
Again calls on Ethics Commissioner to delegate investigation of PMO/AG/SNC-Lavalin situation to a provincial ethics commissioner – Commissioner biased as Trudeau Cabinet chose him after secretive, dishonest process, and senior lawyer also has appearance of bias

OTTAWA – Today, Democracy Watch raised questions about whether federal Conflict of Interest and Ethics Commissioner Mario Dion’s senior lawyer, Martine Richard, is the sister of Jolène Richard, who is married to Trudeau Cabinet minister Dominic LeBlanc (see also here). Ms. Richard heads the Investigations and Legal Services division of the Ethics Commissioner’s office.
If so, in addition to this conflict of interest, Mr. Dion was chosen by the Trudeau Cabinet after a secretive, Cabinet-controlled process that failed to consult with opposition parties as required by the Parliament of Canada Act. As well, Mr. Dion also has a record 8 unethical and questionable actions when he was federal Integrity Commissioner.
If Ms. Richard has this connection with Minister LeBlanc, and given Mr. Dion’s current prolonged medical leave, Democracy Watch again called on Commissioner Dion to delegate to a provincial ethics commissioner (who has no ties to any political party) the investigation of its complaint concerning who tried to influence former Attorney General Jody Wilson-Raybould to intervene and stop the prosecution of SNC-Lavalin by the Public Prosecution Service of Canada (PPSC).
Democracy Watch filed the first complaint with Ethics Commissioner Dion about the PMO/Attorney General/SNC-Lavalin situation on February 8th, alleging that anyone covered by the federal Conflict of Interest Act, including the Prime Minister and PMO staff, who tried to pressure the Attorney General violated section 9 of the Act by using “his or her position as a public office holder to seek to influence a decision of another person so as to… improperly further another person’s private interests.”
Ethics Commissioner Dion sent Democracy Watch a letter on February 26th confirming his investigation of its complaint. Democracy Watch sent a second letter to Ethics Commissioner Dion on March 5th requesting that he expand the investigation into all 11 people whom Ms. Wilson-Raybould named in her testimony before the Justice Committee on February 27th.
“The federal Ethics Commissioner’s office is tainted by bias in favour of the Trudeau Cabinet, and must delegate the investigation of the SNC-Lavalin scandal to a provincial ethics commissioner who is fully independent of any political party,” said Duff Conacher, Co-founder of Democracy Watch. “Ethics Commissioner Dion should not be ruling on any situations involving Liberals as he was hand-picked by the Trudeau Cabinet through a secretive, very questionable process, has a senior lawyer with a family connection to a Cabinet minister, and has an unethical past enforcement record.”
Democracy Watch also called for an independent investigation of Ms. Richard’s family connection to Minister LeBlanc, and her actions and decisions in all investigations and situations since she joined the Ethics Commissioner’s office. It is unclear when Ms. Richard joined the office – although according to a newsletter on the website of her former employer, the Patented Medicine Prices Review Board, she started sometime in September-October 2013.
Incredibly, it seems that employees in the Ethics Commissioner’s office are exempt from the federal, government-wide Values and Ethics Code for the Public Sector and Policy on Conflict of Interest and Post-Employment, and the office seems to be exempt from the requirement to have an internal ethics code set out in section 6 of the Public Servants Disclosure Protection Act.
However, the Ethics Commissioner’s office does have an internal code that, like the government-wide code, requires all employees to avoid even the appearance of a conflict of interest, and to resolve any conflict of interest in the public interest (for example, by not participating in a decision-making process when they have an appearance of a conflict – p. 9). The code also prohibits employees from “granting preferential treatment or advantages to family, friends or any other person or entity” (p. 10). All federal ethics rules define “family” as including family by marriage.
Federal Integrity Commissioner Joe Friday should issue a public statement whether his office has the legal power to investigate Ms. Richard if she is related to Dominic LeBlanc, and if he does he should delegate the investigation to a provincial ethics commissioner given he has an appearance of bias as his former boss was current Ethics Commissioner Mario Dion.
If Ms. Richard, is Dominic LeBlanc’s sister-in-law, the key question is whether Ms. Richard has effectively removed herself from investigations and decisions that affect Trudeau Cabinet ministers, their staff and Liberal MPs since she started in the office, including the investigation of the SNC-Lavalin affair, and also past investigations including the one that led to the ruling finding Dominic LeBlanc guilty of handing out a surf clam licence to a company connected to a cousin of his wife? And an overall question is whether Ms. Richard can serve in such a position given her family relationship to Dominic LeBlanc?
“If Martine Richard has a family relationship with Liberal Cabinet minister Dominic LeBlanc, a fully independent investigation is needed into the actions and decisions of the Ethics Commissioner’s senior lawyer in all investigations and situations since she joined the office, along with a public ruling detailing whether and how she can actually remain in this job,” said Duff Conacher, Co-founder of Democracy Watch.
