Fired instructor disputes college's claim he was a disruptive bully
Rod Cumberland’s lawsuit says he was fired for his anti-glyphosate views
In his second day of testimony in his lawsuit against the college, Rod Cumberland said he was concerned about changes at the college, including what he considered a softening of rules around student absenteeism and behaviour.
"I was trying to get some control back in my classroom, some kind of respect," he said, but new administrators were undermining him by undercutting and second-guessing his disciplining of students.
"I'd been thrown under a bus and run over."

Cumberland is suing the college for wrongful dismissal in Court of King's Bench, saying he was fired in June 2019 for publicly opposing the industrial spraying of glyphosate on public forests in New Brunswick.
He believes industry representatives on the college board pushed for his removal.
On Monday two former college directors testified that industry officials told them they could "get rid" of Cumberland or sanction him.
The college denies firing Cumberland over glyphosate and says it will show the firing was about bullying and disruptive behaviour.
The college's lawyer Clarence Bennett began laying out that case late Tuesday afternoon when he started cross-examining Cumberland.
He signaled he would aggressively challenge the instructor's version of events and paint a different picture of how he acted toward his students and colleagues.
"I'm going to suggest to you that Mr. Cumberland's reputation is a bit of a loaded issue," he told Chief Justice Tracey DeWare. "He has one -- and I'm going to suggest to you that he's earned it."
He challenged Cumberland's claim to being a scientific expert on glyphosate, noting he's had no peer-reviewed articles published on the topic in academic journals.
Bennett read one rejection letter that told Cumberland an article he submitted was "more like an advocacy piece and is not a scientifically rigorous review."
Cumberland's testimony began Tuesday morning with his account of how he became alarmed in the fall of 2018 when college director Tim Marshall and new academic chair Gareth Davies didn't seem willing to enforce long-standing rules about student behaviour.
That included a ban on drinking alcohol during a fall camp in Fundy National Park for students.
Cumberland said he wanted to punish students who had left the camp site to consume beer while watching a hockey game in the village of Alma.

The students had been told the rules at the start of the year and again just before the camp, but Davies felt Cumberland and another instructor were being too strict and the students had done nothing wrong because they were "off-duty."
The incident undermined his authority with students and made it harder for him to enforce other rules, including a ban on wearing hats in class.
"They now think we're a joke," he recalled thinking.
Students knew administrators had second-guessed him and took advantage of it, becoming increasingly defiant, Cumberland said.
He said with no human resources department or union to turn to at the college, his only way to raise his concerns was with the administration.
When he pushed Marshall and Davies to clarify the changing rules and sought meetings with them to make his case, he got no response, he said.
"The only way you have to resolve stuff is to meet, and that was taken away," he said.
When Cumberland kept pushing for a discussion to clarify the rules, Davies wrote in an email that he found the instructor "offensive, disrespectful and insubordinate."
Cumberland said he feared he was being set up for dismissal.
"I felt like I was put right in a corner. I'm trying to do the best I can as a professional to deliver this course and they're not listening. It was extremely difficult, it was extremely embarrassing. I was totally frustrated. … I felt abused."
Cumberland also testified about a seminar on herbicides in January 2019 that is key to the lawsuit.
The college says in its lawsuit defence that Cumberland was "disrespectful and was openly dismissive, rude and insolent" toward federal scientists on a panel discussion about glyphosate.
His lawyer Paul Champ played a video of Cumberland's comments at the seminar where he can be heard asking the panel a question and a panelist can be heard responding.
In testimony, he described his questions as "challenging" but disagreed with a suggestion they were "combative."
Champ also had Cumberland read an email from the University of New Brunswick forestry dean Van Lantz thanking him for his contributions to the discussion.
Behaviour questioned
Cumberland said no one from his own college, including Marshall or Davies, said they were concerned with his actions at the seminar until a June 2019 meeting five months later where Marshall fired him.
"I said 'Are you sure this is what you want to do?'" he said of the meeting. "And he said 'Absolutely.'"
In cross-examination, Bennett brought up several examples of what he suggested was disrespectful behaviour by Cumberland toward students, such as when he used the terms "fruity" and "faggy" in class.
Cumberland said he didn't use the word "faggy" and his use of "fruity" was meant to mean "nutty" or "crazy."
When Bennett said a student was offended, Cumberland said the words weren't aimed at any individual.
"I did not realize that they would take it in that way," he said, adding he apologized to the offended student.
The instructor admitted under questioning by Bennett that comments he made in class about female students doing laundry "could be construed" as sexist.
Champ objected to several of the questions, calling Bennett's approach "trial by ambush." But DeWare said because the lawsuit was making broader claims than simple wrongful dismissal, Bennett had some latitude with his questioning.
Bennett's cross-examination of Cumberland is expected to continue Wednesday morning.
Mr. Cumberland will win this one; probably with a generous financial settlement. I really hope though that the court ruling will be to reinstate the guy.

Robert Whitney, who retired from the position in 2014, testified in Court of King's Bench on Monday about conversations he had about Rod Cumberland after the instructor sent out an email about glyphosate on his college account.
"We can get rid of him. He has no tenure," Whitney remembered being told at the time by Blake Brunsdon, then the chief forester for J.D. Irving Ltd. and an industry representative on the college board.
And Gerry Redmond, Whitney's successor, said he was approached by industry representatives on the college board "on a couple of occasions … wanting me to sanction Rod to prevent him from talking about the glyphosate issue."

Cumberland is suing the college for wrongful dismissal, alleging his 2019 firing from the college was motivated by his vocal criticism of the use of glyphosate by the forest industry.
The college argues it fired Cumberland because he had bullied students and undermined a colleague.
"It had absolutely nothing to do with glyphosate," one of the college's lawyers, Chad Sullivan, said during his opening statement Monday.
"He was terminated because he became intolerable to work with."
Whitney's testimony centred on an email that Cumberland sent on his college account in 2014 calling for a ban on herbicide spraying because of his belief it was responsible for a decline in the deer population in the province.
Whitney said his only objection to the email was that Cumberland sent the email on his college account.

Students and staff were encouraged to follow their passions through community involvement, he said, whether that was in sports, religious groups or other activities.
Cumberland's email prompted a "barrage" of calls, emails and visits to his office by industry representatives, Whitney testified.
Brunsdon, he said, was "concerned that the college's brand had been used to promote a personal interest and he was very much concerned that the students might be exposed to a one-sided perspective … on the use of herbicides."
Whitney told him the use of the college email account was embarrassing but he testified Monday that Cumberland's views were within the acceptable terms of the debate over spraying.
"Even in science, there's lots of room for argument about the validity of one perspective or another," he said.
He rebuffed Irving's offer, in a Jan. 28, 2014 letter from Brunsdon, to present what the company called "a more science-based review" of literature on glyphosate "to ensure that facts are being considered in addition to opinions."

Whitney responded that students were already getting that in their courses.
To have an additional perspective from an outside organization like J.D. Irving Ltd. would be "just the same or worse as having a biased view in the classroom," Whitney wrote in a Jan. 31, 2014 letter.
He told the court that Cumberland had a right to his opinions. "I would be really concerned about a wildlife biologist who was not concerned about the fate of wildlife," he said.
In cross-examination, Whitney acknowledged that his retirement as executive director was five years before the firing.
"The board had turned over quite a bit," college lawyer Clarence Bennett said.
"Right," Whitney said.
The former executive director also admitted that Brunsdon's comments about getting rid of Cumberland didn't lead to anything.
"That didn't happen, right?"
"That's right," Whitney said.
Pushed back
In his testimony, Redmond said that he pushed back on the industry criticism.
"If they had problems with his research, they should bring forth those individuals to counter his arguments, moreso than me suppressing his ability to be a scientist and present his information," he said.
Redmond acknowledged during cross-examination that he got complaints from students and other instructors about Cumberland's classroom behaviour when he was the college director.
In one email Cumberland told a student, "Put on your big boy pants and man up."
Redmond said he didn't think that phrase was condescending or inappropriate.
"Not in the culture of our college. I didn't see it as anything out of the ordinary. It's an expression. What we wanted to do is train these students to take responsibility for their own actions. That's just a figure of speech."
Redmond also acknowledged he had posted allegations on a pro-Cumberland Facebook page without knowing whether they were true or not.
He said a post alleging that the forestry industry was stalling the case from going ahead to run Cumberland out of money for his lawyers was based on "my gut feeling, my opinion."
"I still believe what I said," Redmond said.
"You still believe that Mr. Bennett and myself are financed by the forestry industry?"
"I have no idea," Redmond answered.
In another post Redmond implied that delays in the case getting to trial, including a judge's infection with COVID-19, were suspicious.
"In your view is the judge in on this conspiracy as well?" Sullivan asked.
"There's been delay after delay after delay," Redmond said. While some were legitimate, "it just looks strange to me."
Asked if he was willing to say that the posts were untrue, Redmond answered, "I have no idea whether they're true or not."
Sullivan said Redmond had no more solid basis for his claim that Cumberland was fired over glyphosate.
"You don't really know," the lawyer said. "You've got a gut feeling, right?"
Cumberland starts testimony
Cumberland himself began testifying late on Monday.
He said he began researching glyphosate more than a decade ago when he noticed as a Department of Natural Resources biologist that the deer population was increasing near urban areas but not in public forests.
He started attending seminars where glyphosate was discussed and found them one-sided.
"I thought they might present some of the independent research … but there was nothing about that."
After Tim Marshall, the current director and the man who fired Cumberland, took over as executive director of the college in 2017, Cumberland said he told him that he was involved in the spraying issue and there didn't seem to be any concern.
"I assumed that he knew that that was my issue and those were my concerns, and if there was another seminar I would probably be there to ask questions," he said.
Cumberland's testimony will continue Tuesday.

The worst part is their employees are too scared to speak up too.
You hit the nail on the head. Destroying our environment and biodiversity is just one more casualty of " big business " calling all the shots in our province.
The reality is, it is not about the issue. It is the fact that he had, had complaints about temperament and he may have crossed the line of acceptable use of the college email account.
Curious: How many years did you work for Irving? Be truthful.
Did he distribute and email using the Colleges email address, essentially by the use of it, signifies that his views and the college views are the same. That is what the courts will look at.
And was Rod Cumberland the only person to use an email account " incorrectly " ?
Rod Cumberland was railroaded because his facts and research did not align with
the agenda of Big Business.

People’s Alliance tells nursing home workers to leave rally
While Many New Brunswickers are busy watching the process for the impeachment of the American president, some of the most important politics for the province may be happening just slightly north of the US border in Charlotte County as campaigning to elect a member of the provincial government begins.
On Saturday January 25, the People’s Alliance of New Brunswick (PANB) Party held a rally at the Garcelon Civic Center in St. Stephen. The President and Vice President of the New Brunswick Federation of Labour (NBFL) attended the rally with a group of nursing home workers who live in the area.
During the event, NBFL Vice President Kelly Way shared on Facebook that workers were asked to leave the event once upon arrival, then again, a second time, this time recorded on video. The footage shows a speaker for the event announcing that people are outside waiting to get in and “that they ask that the CUPE members would please leave.”
An angry voice behind the camera responded that “the CUPE members are nursing home workers in this community. We are not ‘CUPE members,’ we are nursing home workers.” The speaker looks as though he is going to respond, but then seems to decide not to, and instead stares down at his shoes. Another voice from directly behind the camera (presumably Way herself) adds, “we live here, and we vote here!”
Way clarified later that the PANB managed to expand the room, allowing them to come back. However, as comments on Way’s post point out, the nursing home workers were asked to leave a third time for “repeatedly interrupting speeches.”
Nursing home workers were protesting the rally because of the help PANB gave the Higgs government to pass a Bill that put conditions on the bargaining process and slashed their right to strike. It is widely believed that in exchange for helping, the Higgs government fulfilled a vital PANB platform point, to make it possible for ambulance paramedics to be professionally reclassified.
The result was Bill 17, passed on Dec. 18 with the support of PANB: A Bill that pins workers against each other.
On the way out the door, Way quotes a PANB supporter saying to the rest of the crowd: “Don’t worry, they do NOT matter”.
The Premier has not yet set the date for the by-election, which may be held any time after the March deadline to set the date. Many are speculating that the Premier will call a general election instead. Higgs even warned Conservative voters in the St. Croix riding of the danger of voting for the People’s Alliance. A CBC article published on New Year’s Eve states that the “Premier cautions Saint Croix against splitting vote between PCs and Alliance, ending in possible Liberal win.”
The PC have also selected a candidate, Kathy Bockus. The PANB candidate is former Maritime College of Forest Technology (MCFT) teacher Rod Cumberland who was terminated from his position in June 2019. Cumberland filed a wrongful dismissal lawsuit against the school for allegedly terminating him because of his vocal opposition to the province’s support of spraying the herbicide glyphosate on Crown forest. MCFT has been consistent in describing the behaviors they claim he was terminated for.
These behaviors included (according to CBC): Making disparaging remarks about the college; bullying, harassing and belittling his students; setting the clock ahead and preventing students who arrived late to enter the classroom; and making inappropriate, offensive, sexist and discriminatory comments. Cumberland denies these allegations.
Though he has yet to make any solid commitments based on the information about the nursing home workers, Cumberland wrote in a Facebook post early on January 31 that he had just visited the inside of Lincourt Manor (the nursing home in St. Stephen) and that it was “an eye opener” despite his Party’s actions in the Legislature. Cumberland has yet to announce that he would do anything inside the People’s Alliance or the Legislature to help nursing home workers if elected.

Maritime College of Forest Technology alleges Rod Cumberland made sexist remarks and belittled students
Rod Cumberland, who's now a People's Alliance Party candidate for the Saint-Croix byelection, was terminated from his teaching position at the college on June 20, 2019.
Cumberland filed a wrongful dismissal lawsuit against the Maritime College of Forest Technology on Nov. 18, 2019, saying he was fired for expressing his views on the forest industry's use of the herbicide glyphosate.
But a statement of defence from the college, filed Jan. 7, says Cumberland was fired for other reasons, including:
Making disparaging remarks about the college.
Bullying, harassing and belittling his students.
Setting the clock ahead and preventing students who arrived late to enter the classroom.
Making inappropriate, offensive, sexist and discriminatory comments. The college's response to Cumberland's lawsuit says he used the terms "faggy" and "fruity" to describe students in the class.
Cumberland denies those allegations in his lawsuit. He says the college did not properly investigate the workplace misconduct allegations against him.
"If it did, the investigation did not meet the most basic standard of procedural fairness," Cumberland's lawsuit says.
Lawyer Response
Cumberland's lawyer said many of the school's allegations are new and were never listed as reasons for his dismissal.
"A lot of these allegations against Mr. Cumberland in our view are completely false and slanderous and have never been raised with Mr. Cumberland at all," said Paul Champ, representing Cumberland. "They're not even referred to in his letter of termination."
Champ argues that because it is the first time those allegations have been brought forward by the school they indicate to him that they were not the reason for Cumberland's firing.
Glyphosate not reason for firing
The forestry school's response to the lawsuit alleges Cumberland began to harass and undermine Gareth Davies, who was appointed to the academic chair position in October 2018, by "constantly questioning his policies, decisions and teaching abilities."
The college alleges Cumberland harassed Davies because he was upset that Davies got the academic chair job over him.
"The plaintiff began a campaign of undermining the authority of Davies by sending his 'concerns' and questioning decisions via email to the entire faculty."
The defence says the emails were "abusive, accusatory and unnecessarily judgmental."
It also alleges Cumberland confiscated his students' personal items, forcefully removed their hats and singled them out in front of the class.
Some of the comments the employer claims Cumberland made in class include comparing abortion to killing animals for management, and saying road-kill meat that's unsafe for human consumption should be given to soup kitchens to "'solve the problem.'"
The college says Cumberland's views on glyphosate were not raised at his termination meeting in June.
Didn't leave immediately
"This is a narrative perpetuated by the plaintiff to avoid responsibility for his offensive and inappropriate behaviour while working for the defendant," say the court documents.
After being told to leave campus immediately once the meeting was over, the college says "the plaintiff did not comply and instead commenced driving around the forestry complex erratically."
Neither the college's nor Cumberland's claims have been tested in court.
Cumberland is seeking $115,442.73 in damages, which he says is equivalent to 14 months reasonable notice of his dismissal. He is also asking for punitive damages, a declaration that his charter rights were violated and to be reinstated as a professor at the college.
Cumberland's lawsuit was filed by Paul Champ of Champ Associates in Ottawa. David W. McMath of McMath law firm in Fredericton is signed on to the document as well.
The college is represented by Stewart McKelvey law firm in Fredericton.
A court date has not been set.
Cumberland began working for the college as a forest operations supervisor in June 2012.
The Maritime College of Forest Technology is located in Fredericton and also has a campus in Bathurst.

In other words, a vast majority of NBers are getting the short end of the stick, and are distorting the entire marketplace by allowing this to continue.
Another interesting point is that the crown lands are managed for maximized profit, not what's best for the overall environment. This means that things like flooding and the effects of chemical sprays are not as high on the priority list as profit. In fact, they don't seem to be on the list.
Also, not on the list is spreading the wealth through jobs/economic opportunities for NBers. Mechanical harvesting doesn't require many ppl, not to mention what clear-cutting does to the landscape.

Forestry college cuts ties with former director who defended fired instructor
Gerald Redmond believes Rod Cumberland was dismissed for his views on glyphosate
The decision comes less than 24 hours after Redmond publicly criticized the dismissal of a well-known instructor at the Fredericton-based college.
Rod Cumberland, a wildlife biologist, was fired on June 20. A letter from the college listed several reasons for the move, but Redmond told CBC News on Wednesday his former colleague's opposition to glyphosate is likely the "real reason."
The following morning, Redmond received a brief letter saying the college was severing ties.
"I wasn't overly surprised," Redmond said Thursday.
Redmond retired after 17 years at the school in 2017, but he had been teaching a few courses through the continuing education program as an independent contractor.
He said he felt pressure from the board of governors during his tenure as executive director to sanction Cumberland on several occasions for his outspokenness on the controversial herbicide used by the New Brunswick forest industry.

On Wednesday, Redmond said Cumberland should be reinstated and he reaffirmed that belief on Thursday.
"You know the college is a wonderful place and it has some really, really good people working there, and I don't want to see them jeopardized either in this controversy," Redmond said.
"But I'm also standing up for someone who I believe in and many, many other people too."
Redmond created a private Facebook Group — called Friends of "Rod Cumberland"— in support of his former colleague. Many graduates posted to the group, calling the firing "outrageous" and questioning the real reasons behind it.
The posts said Cumberland was a teacher who promoted a good work ethic, discipline and punctuality and that he was an ethical, thoughtful and caring instructor.
Calls for investigation
Redmond called on the provincial Department of Post-secondary Education, Training and Labour, which accounts for the majority of the school's funding, to launch a third-party investigation into Cumberland's dismissal. Green Party Leader David Coon made a similar call Wednesday.
The college declined to do an interview but sent a statement that said the reason for Cumberland's termination had nothing to do with his views on glyphosate.

It also accused Redmond of recently disclosing confidential information belonging to the college he obtained while executive director.
"This is a serious breach of his ongoing confidentiality obligations," the statement said. "The confidential information he disclosed was not contained in his comments to the media."
It didn't elaborate further on what the information might be or how Redmond breached his obligations.
Among the accusations against Cumberland listed in the letter are that he prevented students from attending his class because they were late, insisted that they remove their hats in class, and made disparaging remarks in the community about the college, its director and some fellow instructors.
The letter also said he engaged "in communication and a course of conduct, both at MCFT and in the community at large, that constitutes harassment and has caused embarrassment and damage to the reputation of MCFT."
Cumberland said he was surprised by the decision to fire him and is unclear on the college's reasoning.
"It doesn't make sense when you look at it on the surface," he said in an interview Wednesday.
Outspoken on glyphosate
The wildlife biologist and competitive lumberjack has spent 29 years working for the provincial Department of Natural Resources and the college.
After leaving government, he began publicly discussing the effects of glyphosate on New Brunswick's forests and, in particular, the deer population.
The dismissal letter said Cumberland undermined the content of a vegetation management seminar approved by the college. Cumberland said he was accused of deterring students from attending the seminar, adding that was never the case.
'Troublemaking'
Tom Beckley, a professor in the forestry and environmental management department at the University of New Brunswick, has known both Cumberland and Redmond for many years. He said Cumberland sought his advice on what he could and could not say in the classroom.
Beckley said Cumberland knew there could be repercussions with his choice to not self-censor. He said speaking against the status quo in the forestry industry is often seen as "troublemaking" or "advocacy."
But he said debating clashing opinions is part of a post-secondary institution's mandate.

"I think conversations like that are exactly what we should be doing with our students, not telling them what the right answer is but also not hiding our own opinions," Beckley said.
Cumberland said he encouraged his students "to look at all the science" and critique his views.
"Look at what I'm saying, see if it's true or not," he said. "I think that's a wise thing to do [for] anything in life. Get all the facts before you make a decision."
The college, originally called the Maritime Forest Ranger School, was established as a co-operative venture of the New Brunswick and Nova Scotia governments and forest industries, according to the college's website.
Its Fredericton campus is on the grounds of the Hugh John Flemming Forestry Centre, also a co-operative venture of government agencies, educational institutions and industry associations.

I have known Rod Cumberland for 10 years and have done business with him for a Tree Removal as well. He is the most honest and hard working person I have dealt with and I know him as a personal friend. I feel it is very suspicious that the Forestry College can fire someone for following their own rules? The Glyphosate issue is the real culprit as he is against it. When a Company as large and as politically connected as Irving can have someone fired for no apparent reason it begs to question what they are having their teachers teach these impressionable students. It used to be that truth and honesty counted for something but this is a blatant abuse of power by a wealthy Company like J.D. Irving. Just ask Dr. Eilish Cleary who was studying glyphosate when put on leave, then terminated.

Since some have taken my earlier comments (on Mr. Cumberland's dismissal) to task by completely misreading what I was actually saying...such is what happens I guess in today's media. I mentioned Mr. Cumberland's "hubris" and those that understood the word's meaning completely misunderstood the context of what I was saying. In fact, I was being ironic and maybe a little sarcastic, but if people reading such submissions would bother to take the time to actually read; not just casually skim such things, there might be better understanding.
My point was and is that Mr. Cumberland and now apparently Mr. Redmond, have lost their jobs because those jobs weren't as important, TO THEM, as their enunciating their very real concerns with the continuing use of forestry chemicals which have been condemned by many other nations. I don't how one does it, but may I suggest to someone who does know, that a "GO FUND ME" (I think that's what they're called) be started to help both men if they wish to seek redress via the courts.

"Because even when I was the executive director, I felt pressure from the board of governors in several instances, to try to sanction Rod for his outspokenness on the glyphosate herbicide."
Redmond said the forest industry does not like what Cumberland says on the issue. He said he should be reinstated.
Statement from the board
The college's board of governors responded to an interview request with a statement Wednesday afternoon that said it will not comment on personnel issues, while reaffirming support for current executive director Tim Marshall.
The board also said it's aware of Redmond's views, saying he "was not involved in the decision in question nor was he privy to the information that led to the decision."
Green Party Leader David Coon said the Department of Post-secondary Education, Training and Labour should launch an internal inquiry into the matter and make the results public.
He said it's another instance in which an institution is not standing up to the "powers that be"— meaning government and the forestry sector, he said. It's not the first time that action has been taken against a scientist who has been outspoken about forestry industry practices, he said.

'Court cases being won'
Cumberland said modern, independent studies on glyphosate are producing more evidence that the product can be harmful to animals, including humans. In 2015, the World Health Organization classified the herbicide as "probably carcinogenic to humans."
"There are court cases being won all across North American right now based on a lot of evidence, and I think that evidence speaks for itself," he said.
Bayer, which purchased glyphosate-producer Monsanto, was ordered by a Californian jury in May to pay $2 billion in damages to a couple who alleged the herbicide gave them cancer.
Plaintiffs in two other Californian cases were awarded tens of millions of dollars in damages. The company disputes the allegations that the product can be linked to cancer and is appealing the decisions.
The product is banned in several areas across the globe, including on Crown land in Quebec.

In Canada, separate class-action lawsuits against Bayer and Monsanto have been launched in Saskatchewan and Quebec.
Health Canada says glyphosate is "not genotoxic and is unlikely to pose a human cancer risk."
The New Brunswick government announced a reduction in herbicide spraying earlier this year.

I don't and won't pretend, as some do, that I have the scientific knowledge or expertise to judge whether or not Mr. Cumberland should have been let go, but I strongly suspect that he was a casualty of his own hubris, in thinking that his educated opinion was more important than the opinions (educated or not) of those who decide things like his ongoing employment. The one inadvertent thing that I think IS happening when such firings occur and are publicized is that people, hence voters, become more aware of what is happening, and has been happening, in the forests of New Brunswick. Forestry companies should take note!

Northrup made the long-awaited announcement today in Fredericton. The annual allowable cut for softwood, such as spruce, fir and jack pine, is 3.27 million cubic metres, which is the same annual allowable cut as in the 2007-2012 management plan. Northrup said the department's projections show the annual allowable cut for softwood lumber can be maintained at the existing level. Meanwhile, the Department of Natural Resources is cutting the annual allowable cut for hardwood to 1.41 million cubic metres from 1.77 million cubic metres in the 2007-2012 plan. The 21 per cent reduction will ensure a sustainable hardwood supply in the future, according to the department. "It would be in no one's interest to harvest hardwood species at a level that would require an even larger AAC reduction in the future, the natural resources minister said. "This reduction is necessary and, at the same time, it represents an opportunity for the province's private woodlot sector to sell more wood into the marketplace, which is a top priority for our government.'' Northrup said his forest management plan is "balanced." He said it would help support the environment and maintain jobs in the industry. "It strikes the best balance possible while preserving jobs in rural and northern New Brunswick, where forestry remains a major employer and a $2.7-billion industry," he said. The forest management plan also outlined how: the amount of forested Crown land designated as protected natural areas is increased to eight per cent. 28 per cent of Crown forest is designated as "conservation forest." "non-clearcut harvesting measures" would be implemented. The management plan starts in April 2012 and continues until March 31, 2022. The 10-year plan is double the normal length of the previous forest management plans. Northrup said the recommendation for a longer management plan came from a government-appointed management plan. "The Crown Land Task Force on timber objectives recommended we move to a 10-year planning cycle in order to provide greater certainty on allocation levels as well as commitments to conservation measures,'' Northrup said. The natural resources minister said the longer plan will give more predictability for the forest industry. The Alward government hired two task forces to study Crown land and private land task force. David Coon, the executive director of the Conservation Council of New Brunswick, said he has concerns with the forest management strategy, but said it is a vast improvement. "The plan they released today is far better than what the industry was lobbying for and it is far better than what the Liberals had proposed when they were they government, he said. "But it is moving in the wrong direction for most New Brunswickers who say their number one priority areas are to protect water and to protect wildlife." Coon said he's concerned about a reduction of deer wintering areas and the size of buffer zones around water courses. The forest, which is set aside for habitat zones and watercourse buffers, will be reduced to 28 per cent from 30.5 per cent, Coon said. Industry concerns Robert Fawcett, the director of forestry relations for J.D. Irving Ltd., said the forest management plan will mean two mills will remain closed. (CBC) Several forest operations in the province have closed in recent months because in the uncertainty of the industry. Robert Fawcett, the director of forestry relations for J.D. Irving Ltd., said its Clair and Deersdale mills will remain closed. He blamed the extended closure on cost uncertainty in the government's plan. He said the company is "really concerned" about the impact on its employees and the communities where its mills operate. "For us at the moment, our mill capital expansions are put on hold, Fawcett said. "We are not going to be able to invest in our facilities today until we hear a more certain number in terms of the wood that is going to be available for those facilities." The closure of the Deersdale mill near Juniper put more than 70 people out of work in October. Another 73 people were put out of work in September when J.D. Irving closed its mill in Clair. The forest industry had been lobbying to make sure the annual allowable cut was not reduced. Last June, J.D. Irving Ltd. organized a petition campaign aimed at provincial politicians that said hundreds of jobs were at stake if the provincial government reduces allowable cuts of some types of trees by 25 per cent. Fawcett said J.D. Irving Ltd. is very concerned about the new standards that are being put in place, which will make it more expensive to cut trees in the province. "We need to be very concerned about the implementation about these new standards that DNR is putting in place by April 1. These new standards will increase the cost of harvesting wood significantly," he said. Irving spokesperson Mary Keith says Miramichi Lumber Products has plenty of its own allocation on Crown lands that it hasn't used. Miramichi Lumber CFO Hal Raper previously told CBC News that the licensee operating the public forests in the Miramichi area, Fornebu, was allowing saw logs to go to JDI, depriving the local mill of that wood. The Miramichi Lumber Products mill announced on Friday it was closing because of a shortage of Crown wood. (CBC) That prompted a strongly-worded statement from Keith, who called the suggestion "absolutely false." "Our company has in fact been working with Miramichi Lumber Products to buy their wood chips and send saw logs to their mill," said Keith. "The allocations are a matter of public record and we are fully compliant." She said Miramichi Lumber "have never harvested the full amount allocated to them" in any of the last four years. The company has not operated year-round in any of the last four years, which may explain why it hasn't used all of its allocation. Forestry firms eye $1B in spending, J.D. Irving Ltd. says Miramichi Lumber Products mill shuts down again Miramichi Lumber said last week it would shut down this Friday, laying off 110 people, because it's only been able to secure 40 per cent of its allocation of wood from publicly-owned forest land. "Everybody wants more wood," Raper said on Monday. "I think the government has to decide what their priority is and who they're going to support." Raper said Fornebu was able to send logs to Irving because the province wasn't enforcing usage standards, which set out how much of the tree can be used for saw logs and how much for stud logs. Irving Ltd. continued its ongoing push to get the province to commit to increasing the Crown wood supply for industry over a longer term. He also doubled the normal management plan from five years to 10, to give companies more predictability. Irving says that's an improvement, but it doesn't go far enough. Keith said it doesn't provide "the long-term certainty of wood supply to warrant hundreds of millions of dollars of investment. "We need to know the government is interested and is working to grow the wood supply." Keith says JDI is one of several forestry companies prepared to invest a total of almost $1 billion in its facilities, but only if the wood supply is secure. She said that would include a major upgrade to the company's Saint John pulp mill. "We need a longer-term view and a longer-term determination of what the timber objectives, what the timber supply is going to be, so we can go forward with investments," Keith said. The loan is listed on the same order-in-council (OIC) document that authorized the government to buy Umoe Solar's assets, although the two do not otherwise appear linked. Business New Brunswick spokeswoman Marie-Josee Groulx said the loan was not linked to negotiations that eventually saw the Umoe purchase price reduced from $17 million to $10.8 million. "It's just on the same OIC," said Groulx, who stated she'd been told by Economic Development Minister Paul Robichaud. "We treat them as two separate entities. Fornebu is its own operating thing, and Umoe was its own case file." The loan will go toward the Bathurst sawmill owned by Fornebu since taking over all of UPM-Kymmene's former New Brunswick properties, including the Miramichi site. It is for a period of six years, and Groulx said the money would be used for a new biomass boiler for the plant, which currently uses more expensive propane for heat. The OIC also authorizes the government to buy up the assets at the site of Umoe Solar's formerly planned polysilicon plant, for a price of up to $17 million. That deal was made in 2009 by the former Liberal government, to come into effect if Umoe Solar had not gone ahead with its planned plant by January 2011. Groulx said at the time of the OIC, June 16, the final deal to knock the price down to $10.8 million hadn't been finalized. "At that point, we were still on the hook for up to $17 million, as part of the original agreement, but they were able to negotiate downwards," she said. Although Umoe Solar is no more, Fornebu continues to manage the enormous Crown License 3 formerly managed by UPM. Miramichi - Bay du Vin MLA Bill Fraser, who was part of the Liberal government that made the $17 million purchase deal, said Fornebu's control of the license was linked to creating jobs in Miramichi. Now that the planned polysilicon plant is no longer a go, he said, Fornebu's management of the license should be revoked. He said the Natural Resources Department should take over managing the license, with Fornebu remaining as a sublicensee. "If Fornebu is creating jobs, and I believe they are, and opportunities in the Miramichi region, and I believe they are, I think that they should continue to use that wood at that site," he said. "But ... they shouldn't be running the entire allocation. That should be immediately taken away." Fraser said he was not made aware of the $17 million purchase deal at the time it was made in 2009, saying that would have been a cabinet decision. He argued the polysilicon plant project failed due to global factors beyond anyone's control, though he said the failure of the NB Power deal made matters worse. He criticized Robichaud for slamming the $17 million purchase agreement as a "bad deal" for taxpayers. "I'm very disappointed in Paul Robichaud, you know, criticizing everything we've done to help the Miramichi." Department of Natural Resources (DNR) spokeswoman Anne Bull Monteith said Fornebu has been the manager of the license since 2009. The 1979 Trooper song Raise a Little Hell blared on the speakers at the 8th Hussars Sports Center Friday evening as people filed in to watch the Fundy candidates debate the issues. It was an accurate, if unofficial, theme song for the debate. The crowd of over 200 spectators was dwarfed by the huge arena, but as they chose their seats, it was clear the battle lines were drawn. Supporters of Conservative candidate Rob Moore naturally took the blue chairs on the right of the rink floor while John Herron's Liberalswent left. There were splashes of orange, supporters of NDP Pat Hanratty, mixed throughout. Perhaps the loudest applause came from a row towards the back, where supporters of independent candidate David Amos sat. The debate was moderated by Leo Melanson of CJCW Radio and was organized by the Sussex Valley Jaycees. Candidates wereasked a barrage of questions bypanelists Gisele McKnight of the Kings County Record and Lisa Spencer of CJCW. Staying true to party platforms for the most part, candidates responded to questions about the gun registry, same sex marriage, the exodus of young people from the Maritimes and regulated gas prices. Herron and Moore were clear competitors,constantly challenging each other on their answers and criticizing eachothers' party leaders. Hanratty flew under the radar, giving short, concise responses to the questions while Amos provided some food for thought and a bit of comic relief with quirky answers. "I was raised with a gun," Amos said in response to the question of thenational gun registry. "Nobody's getting mine and I'm not paying 10 cents for it." Herron, a Progressive Conservative MP turned Liberal, veered from his party'splatform with regard to gun control. "It was ill advised but well intentioned," Herron said. "No matter what side of the house I am on, I'm voting against it." Pat Hanratty agreed there were better places for the gun registry dollars to be spent.Recreational hunters shouldn't have been penalized by this gun registry," he said. The gun registry issues provoked the tempers of Herron and Moore. At one point Herron got out of his seat and threw a piece of paper in front of Moore. "Read that," Herron said to Moore, referring to the voting record of Conservative Party leader Steven Harper. According to Herron, Harper voted in favour of the registry on the first and second readings of the bill in 1995. "He voted against it when it counted, at final count," Moore said. "We needa government with courage to register sex offenders rather than register the property of law abiding citizens." The crowd was vocal throughout the evening, with white haired men and women heckling from the Conservative side. "Shut up John," one woman yelled. "How can you talk about selling out?" a man yelled whenHerron spoke about his fear that the Conservatives are selling farmers out. Although the Liberal side was less vocal, Kings East MLA Leroy Armstrong weighed in at one point. "You're out of touch," Armstrong yelled to Moore from the crowd when the debate turned to the cost of post-secondary education. Later in the evening Amos challenged Armstrong to a public debate of their own. "Talk is cheap. Any time, anyplace," Armstrong responded. As the crowd made its way out of the building following the debate, candidates worked the room. They shook hands with well-wishers and fielded questions from spectators-all part of the decision-making process for the June 28 vote. By Gisele McKnight FUNDY--He has a pack of cigarettes in his shirt pocket, a chain on his wallet, a beard at least a foot long, 60 motorcycles and a cell phone that rings to the tune of "Yankee Doodle." Meet the latest addition to the Fundy ballot--David Amos. The independent candidate lives in Milton, Massachusetts with his wife and two children, but his place of residence does not stop him from running for office in Canada. One has only to be at least 18, a Canadian citizen and not be in jail to meet Elections Canada requirements. When it came time to launch his political crusade, Amos chose his favourite place to do so--Fundy. Amos, 52, is running for political office because of his dissatisfaction with politicians. "I've become aware of much corruption involving our two countries," he said. "The only way to fix corruption is in the political forum." The journey that eventually led Amos to politics began in Sussex in 1987. He woke up one morning disillusioned with life and decided he needed to change his life. "I lost my faith in mankind," he said. "People go through that sometimes in midlife." So Amos, who'd lived in Sussex since 1973, closed his Four Corners motorcycle shop, paid his bills and hit the road with Annie, his 1952 Panhead motorcycle. "Annie and I rode around for awhile (three years, to be exact) experiencing the milk of human kindness," he said. "This is how you renew your faith in mankind - you help anyone you can, you never ask for anything, but you take what they offer." For those three years, they offered food, a place to sleep, odd jobs and conversation all over North America. Since he and Annie stopped wandering, he has married, fathered a son and a daughter and become a house-husband - Mr. Mom, as he calls himself. He also describes himself in far more colourful terms--a motorcyclist rather than a biker, a "fun-loving, free-thinking, pig-headed individual," a "pissed-off Maritimer" rather than an activist, a proud Canadian and a "wild colonial boy." Ironically, the man who is running for office has never voted in his life. "But I have no right to criticize unless I offer my name," he said. "It's alright to bitch in the kitchen, but can you walk the walk?" Amos has no intention of actively campaigning. "I didn't appreciate it when they (politicians) pounded on my door interrupting my dinner," he said. "If people are interested, they can call me. I'm not going to drive my opinions down their throats." And he has no campaign budget, nor does he want one. "I won't take any donations," he said. "Just try to give me some. It's not about money. It goes against what I'm fighting about." What he's fighting for is the discussion of issues - tainted blood, the exploitation of the Maritimes' gas and oil reserves and NAFTA, to name a few. "The political issues in the Maritimes involve the three Fs - fishing, farming and forestry, but they forget foreign issues," he said. "I'm death on NAFTA, the back room deals and free trade. I say chuck it (NAFTA) out the window. NAFTA is the North American Free Trade Agreement which allows an easier flow of goods between Canada, the United States and Mexico. Amos disagrees with the idea that a vote for him is a wasted vote. "There are no wasted votes," he said. "I want people like me, especially young people, to pay attention and exercise their right. Don't necessarily vote for me, but vote." Although...if you're going to vote anyway, Amos would be happy to have your X by his name.
