If accurate, this is a travesty and a failure in the shared risk pension scheme. To be sure, the Vestcor officials will want their undeserved bonus for failure to meet reasonable pension fund benchmarks.

Shared-risk plans struggle to keep up with record inflation

In a report to members this month, trustees of the Public Service Pension Plan which provides retirement benefits to about 18,000 former New Brunswick government department and crown corporation employees and their survivors said it will increase pension payments 5.24 per cent in 2023, instead of the 5.56 per cent it calculated the full cost of inflation to be.

The shortfall will cost the average retiree in the pension plan about $80 next year.

The report said the foregone amount "may be awarded in the future," if financial returns and funding levels in the pension fund allow it. 

"This will be assessed in next year's Actuarial Valuation Report,' said the report.

Shielding pensioners from inflation losses had been a point of pride for trustees up until this year, telling members in a statement this spring that "the strong financial health and stable growth"  of the pension fund was helping "members keep pace with the increase in today's cost of living, today and into the future."

Clifford Kennedy, a retired government employee and spokesperson for the coalition of former civil servants who unsuccessfully fought the conversion of their public pension plans to private control beginning in 2012, said less than full inflation protection will be hard on some retirees.

"We, like anybody else on a fixed income, have bills to pay and every one of those bills have gone up," said Kennedy.

Retired New Brunswick teachers will be the worst off.

Trustees of their pension fund will decide later in September what inflation adjustment former educators will get for 2023, but it is guaranteed to be well below both inflation and the 5.24 per cent announced for former civil servants.

Teachers have two inflation restrictions in their pension plan civil servants don't, including a provision that limits annual pension changes to 75 per cent of an inflation increase.  A second provision caps inflation increases at 4.75 per cent per year.

Larry Jamieson, the chair of the Board of Trustees of the New Brunswick Teachers' Pension Plan, said it is unclear in the text of pension plan documents if retired teachers are entitled to 75 per cent of the 5.56 per cent increase in inflation (assuming the pension plan can afford it) or are only entitled to 75 per cent of the 4.75 per cent cap.   

One amount would generate a cost of living increase for pensioners of 4.17 per cent in 2023 and the other would generate 3.56 per cent.

Inflation in Canada this year is running at a 30 year high and Jamieson said the cost of living cap on teachers' pensions had been a non-issue for so long, it is not clear exactly how it works.

"It is confusing and that is one of the questions trustees will have to debate at the end of the month," said Jamieson on Wednesday.

"It never had an impact because we were never close to it."

Pension changes introduced by the former government of Progressive Conservative premier David Alward's government, when Blaine Higgs was minister of finance, converted  provincial public service pension plans from defined-benefit systems backed by government guarantees to what it called a shared-risk system.

Under the old system, retirees were guaranteed a fixed level of benefits and if the pensions were short of funds, the province had to cover the difference.

The new system eliminated the guaranteed level of benefits and relies on investment returns generated by the firm Vestcor to fund pensions.

Change announced to senior government leadership

FREDERICTON (GNB) – Premier Blaine Higgs has announced a change to the senior ranks of the provincial public service.

“A deputy minister plays an important role as both team leader and as support to the work being done by the minister,” said Higgs. “It is key to have right person in place to ensure our government is able to best serve New Brunswickers and focus on the goals we have set.”

Effective Dec. 6, Rob Taylor will become deputy minister of Transportation and Infrastructure. He is coming to the position from Winnipeg, where he is currently the assistant deputy minister of infrastructure capital projects with the Manitoba Infrastructure Department.

The New Brunswick Teachers' Pension Plan (NBTPP)

The primary purpose of the New Brunswick Teachers’ Pension Plan (NBTPP) is to provide secure pensions to Teachers upon retirement and until death (including subsequent benefits to their spouse and eligible dependents as applicable) in respect of their service as teachers. Since 2014, the pension plan is managed by a Board of Trustees. The Board is responsible for the overall administration of the NBTPP, including oversight of the investments.

The Vestcor Investment Management Corporation (VIMC), formerly the New Brunswick Investment Management Corporation (NBIMC), provides investment management and advisory services to public sector-based pension funds and other pools of investment capital. The transition to VIMC took place on October 1, 2016 under the Vestcor Act by the Province of New Brunswick.

The New Brunswick Teachers’ Federation is responsible for pension services, although the Associations have appointed members of their respective staff to work in this area.

RCMP probing alleged threats against N.B. principal over O Canada flap

The principal of Belleisle Elementary School has filed a complaint with the Sussex RCMP after he alleged he received a slew of death threats because of his decision to limit O Canada to school assemblies.

Erik Millett alleged in a CBC News interview this week that he received death threats on the phone and through email, and was even threatened by one parent in his office.

The RCMP say they're focused on finding the person responsible for one particular face-to-face death threat and are counting on Millett' s co-operation to expand their investigation.

Millett said he never expected to be the target of abuse over his decision.

"The emails flooded in and then the death threats started," he told CBC News.

"I received threats by email, death threats over my phone at home. I had to have my telephone number changed."

Hard to probe email threats: police

Sgt. Claude Tremblay said the police are also aware of email threats that Millett alleged he received after his anthem decision became widely known.

Tremblay said it is more difficult for the police to investigate alleged electronic threats.

The RCMP received a complaint about the electronic threats more than a week ago and the police are investigating those email threats.

Millett became the focal point in a national debate over patriotism when it was learned that he stopped the daily playing of the national anthem in his school. The anthem is now reserved for monthly assemblies.

Millett said the decision was made to accommodate students whose parents objected to the morning ritual over religious grounds.

N.B. school principal received death threats in anthem dispute

School principal Erik Millett says he was flooded with hostile messages, including taunts and death threats, after his decision to stop the daily singing of the national anthem at Belleisle Elementary School in New Brunswick.

Millett, the school's principal, said in an exclusive interview with CBC News that he was inundated with more than 2,000 emails over the anthem controversy, but some of the negative messages crossed the line and became personal threats.

'He said that I should be ashamed of myself, that I embarrassed the community. He said that if my admin assistant wasn't there he would drag me outside by my shirt collar to the parking lot and beat me senseless.'— Erik Millett, school principal

Those threats were not relegated simply to the phone and internet. Millett also described how at the height of the anthem debate, he was sitting in his office with a student when a local parent walked in to speak with him.

"He said that I should be ashamed of myself, that I embarrassed the community. He said that if my admin assistant wasn't there he would drag me outside by my shirt collar to the parking lot and beat me senseless," Millett said.

"At that point, I said that our conversation, our meeting was over and I thanked him for coming in and sharing his opinion and I asked him to leave my office. He told me that I would be driven out of the community one way or the other."

The national controversy ignited after it became known that Millett had stopped the daily singing of O Canada at his elementary school in rural New Brunswick. Instead, students would sing the anthem monthly at a school assembly.

Some of New Brunswick's Conservative MPs attacked the move on the floor of the House of Commons as "political correctness run wild." Eventually, the district superintendent ordered that the anthem be returned as a daily practice in the school. 

The principal said he is now seeing a psychologist as he attempts to overcome the backlash over the anthem dispute.

"It's pretty traumatic. I just hope that no teacher, no administrator has to go through something like that again," he said.

Principal didn't want to separate students

Millett has said that two parents objected to the anthem ritual on religious grounds, and that he and his staff took the necessary steps to foster an inclusive school.

Those measures, he said, are supported by human rights legislation and the Education Act.

He also bristled at the idea that students who did not want to be a part of the anthem's singing should step outside.

"Asking a student to leave the classroom every day at the primary level, I think that is unacceptable. That is not the kind of environment I want to create in a school where I'm at," he said.

"If I was a student I would not want to begin my day every day to leave the classroom and be separated from my peers."

But Millett said he was open to making accommodations for students who felt strongly about the anthem. He said he allowed Julia Boyd, whose mother Susan has led the charge to reinstate the daily song, to sing OCanada at the monthly school assemblies.

Parent asks: 'What about the majority?'

Susan Boyd, whose soldier nephew was killed in Afghanistan, said national symbols must stop being removed from the classroom.

"The Lord's Prayer is gone. The [Oath] of Allegiance is gone. It has come to the point that we don't want to offend the minority, we don't want to offend people," Boyd said.

"But what about the majority? Because we are at the point now that we are offended because our anthem is disappearing."

The anthem is once again being piped into classrooms at the elementary school over the public address system. And while O Canada has returned, it is not clear if Millett ever will.

"I really don't know when I'll be able to return to work. [I am] personally devastated by this," he said.

"I don't know whether I'll ever return to teaching or a principalship again."

It is great to see teachers returning to work ; but thinking that
learning from home via the internet will work for kids is a bit of a
joke . Education works because schools are structured , and provide a
structured learning environment . Cardy squandered $840,000 of the
taxpayers cash on computer equipment that was not needed . Not to
mention , who does Cardy think will be taking care of these kids at
home in the fall when their parents have returned to work . Stay at
home education for kids is a non starter

equipment was a way of throwing technology at a problem that was
caused only partly by lack of technology. The only way learning from
home works is when parents have both the ability and the time to
support children by filling in the gaps in Internet-based learning. It
doesn't work when the parent lacks the ability to do this or when the
parent is busy working - even if they're working from home, let alone
working outside the home.

Vestcor's record bonuses, modest returns again provoke call for review by auditor general

Auditor general should have authority to oversee pension agency, Liberals say

"While Vestcor is not a Crown Corporation, they are responsible for handling the pension fund for Government of New Brunswick employees and therefore need to be held accountable," Rob McKee, the Liberal finance and treasury board critic, said in a statement Monday.

The Moncton Centre MLA was reacting to news Vestcor created a new incentive plan for its employees in 2021 but without fully cancelling the plan it replaces. Instead, both operated simultaneously in 2021, rewarding employees for the same achievements twice in many cases.   

The new incentive program was fully functional in 2021 and employees earned $5.9 million in bonuses from its operation.

Bonus from two programs

That  was a new bonus record for Vestcor on its own, but employees were then paid another $2.7 million from the old incentive program that is being left partially operational until 2023. 

"The exorbitant amounts of bonus pay given to senior employees is a major reason why the Auditor General should have the authority to analyze Vestcor's operations," said McKee's statement.

"As most of what they do is manage the pensions of Government of New Brunswick employees, they are responsible for handling a large sum of taxpayer dollars, which makes transparency and accountability that much more important."

Vestcor is headquartered in Fredericton and was set up in the 1990s to manage what has become $21 billion in New Brunswick government employee pension and other funds, including about $900 million in N.B. Power nuclear waste and decommissioning funds.

It was originally a Crown agency but was reconfigured, renamed and given its independence in 2016.

It's now jointly owned by the province's two largest public pension plans serving New Brunswick civil servants and teachers.

Although Vestcor is not owned by government, two New Brunswick auditor generals have argued "the significant amount of funds from public sources Vestcor manages" and its "extensive government-entity client base" make its operations a public interest concern.

Most of the bonus payments awarded to Vestcor employees in 2021 were generated by investment returns that exceeded Vestcor's own internal targets but which were otherwise below industry averages, according to at least one measure.

According to Vestcor's annual reports, earnings on the funds it manages have totalled $5.5 billion over the last four years covering 2018 to 2021. 

The amount exceeded the organization's benchmark investment targets for the periods by $652 million after covering the organization's expenses. That includes $452 million in returns above Vestcor's benchmarks in 2021 alone.

That's the source of most of the bonus payments — the difference between Vestcor's 2021 investment returns of 9.46 per cent and its overall target in 2021 of 7.23 per cent.

"Investment returns relative to our client's investment policy benchmarks reached a record high due to the strong active management performance from each of our four investment teams," Vestcor's annual report said.

But according to data compiled by LifeWorks, a Canadian pension and benefits administrator that monitors the performance of pension managers and which Vestcor has used for comparisons in the past, a 9.46 per cent investment return in 2021 would rank it among the bottom five per cent of results among pension managers with diversified pooled funds. 

The median return among funds for the year, according to LifeWorks, was 13.83 per cent. 

It is a similar story for Vestcor's four-year annualized return of 7.5 per cent. It is also well above its own benchmark target of 6.52 per cent over those years but below the 8.8 per cent LifeWorks calculates to be the median return of diversified pension funds.

Every one per cent difference in investment returns is worth about $200 million per year to Vestcor's holdings.

In February 2021, then New Brunswick auditor general Kim Adair, formerly Adair-MacPherson, told MLAs her office had an interest in reviewing Vestcor's investment targets and benchmarks to evaluate the difficulty in exceeding them.

"There is a lot of content in their annual report about benchmarks and achieving benchmarks and other targets," said Adair.

"These are the areas if we had the ability to do performance audits we would examine whether the benchmarks are, for example, stretch targets or are they easy to achieve benchmarks."

Adair said she was concerned about how bonus payments at Vestcor had been escalating without, in her view, an independent measure of whether the returns being earned justify the payments or are as strong as Vestcor claims relative to industry standards.   

"Are they adding the value that they indicate in their public reports?" she asked.

"Essentially there's no third-party independent assessment of this, and they are managing significant New Brunswick public sector funds." 

Vestcor president John Sinclair has regularly defended the organization's record of posting lower earnings than industry averages. He said it is byproduct of a conservative, low-risk investment strategy required to manage the province shared-risk pension plans that will show its true worth when markets slump. 

Vestcor says its costs are lower

He also contends costs at Vestcor are substantially lower than at other pension management firms, and this makes up for some of the earning shortfalls.

"The idea has been to provide that protection to our members," Sinclair told MLAs last September. "Our pension plans should do better in weaker market environments. But to be able to do that, they're going to probably not do as well in stronger market environments."

New Brunswick Liberals say they would like to see all of those issues evaluated by the Auditor General's Office, but in an email on Monday, the Department of Finance said that won't happen.

"Vestcor is not an agent of the Crown and was established to operate independently of government," wrote Erika Jutras, the department's communications director. 

"There is no plan to change the legislation."

Investment managers and executives with the Fredericton-based firm that oversees New Brunswick government employee pension funds earned a record $8.6 million in bonus pay in 2021 from two incentive programs that operated simultaneously, records show.

The bonuses earned by senior personnel of Vestcor were $3.3 million higher than the previous record amount paid in 2019 and $4.3 million higher than what was paid in 2020. 

Much of the increase was generated by the operation of two bonus programs in 2021 that in many cases paid rewards to employees for the same achievements twice.

The size and growth of Vestcor's bonus program is one of the issues New Brunswick's Office of the Auditor General said in 2021 it would like to review with the organization. At the time, Vestcor disputed that it is subject to the auditor general's authority any longer, in what has become an ongoing issue between the two.

"Vestcor's accountability to government, the Legislative Assembly and the public remains a significant concern for our Office," declared a report issued by new Auditor General Paul Martin earlier this year.

"Two of our most significant areas of concern continue to be NB Power's ability to self-sustain its operations and the Auditor General's access to Vestcor."

It's now jointly owned by the province's two largest public pension plans serving New Brunswick civil servants and teachers, but it also oversees the retirement plans of hospital workers, nurses, Crown corporation employees, provincial court judges, MLAs and other groups.

Vestcor also manages other investment accounts, including University of New Brunswick endowment funds, retirement accounts for other organizations like the City of Fredericton and nuclear waste and decommissioning funds for NB Power.

Although Vestcor is not owned by government any longer, two New Brunswick auditor generals have argued "the significant amount of funds from public sources Vestcor manages" as well as its "extensive government-entity client base" make its operations a public interest concern.

Auditors concerned

Vestcor has offered incentive programs to employees for more than two decades. The organization argues bonus pay is standard in the investment industry, helps to recruit and retain quality employees and incentivizes good performance. 

In Vestcor's case, bonus payments started out at modest levels but over the years grew significantly, an issue that eventually caught the attention of auditors.

"The Auditor General should have unrestricted access to audit the reasonableness of Vestcor's incentive program," former New Brunswick Auditor General Kim Adair-MacPherson wrote in her report on the matter in early 2021. 

"Vestcor has paid over $30 million in employee incentives (bonuses) since 2010 and incentives have increased by almost 500 per cent since 2010. Five senior executives have received almost $19 million in incentives and salary since 2014."

In its latest annual report released last week, Vestcor disclosed there had been an internal overhaul of "incentive pay" at the organization that took effect on Jan. 1, 2021 — just before Adair-MacPherson's report — that further boosted bonuses from amounts she was already concerned about. 

Vestcor created a new simplified bonus pay structure to replace the previous system and added both enhancements and restrictions.

One new rule requires bonus amounts earned by employees to be paid out over four years, including 50 per cent in the first year and equal amounts in subsequent years with interest accumulating on amounts not immediately paid out. 

Promises were also made to employees that the new bonus plan would be as generous as the one it replaced and would produce "outcomes similar to those under the prior program."

Despite that, there was also a decision not to completely end the prior bonus program when the new one took effect.  Instead, Vestcor's board of directors voted to keep the most lucrative part of the original bonus system operating alongside the new system for 2021, 2022 and 2023.

"Employees … will continue to be eligible to receive annual payments determined under the previously existing … plan," explained Vestcor in its annual report about the decision to run two bonus systems simultaneously.

"These remaining applicable payments will continue to be subject to Board of Director approval." 

Double bonus payments

The result was double bonus payments and record earnings for a select group of Vestcor employees in 2021, including the organization's four most senior executives.

John Sinclair, Vestcor's longtime president and chief executive officer, who received $882,721 in bonus pay in 2019 and $681,412 in 2020 under the old incentive plan, received $1,278,750 in 2021. 

About two-thirds of Sinclair's bonus pay, $828,750, was generated by the new bonus system but $450,000 came from the old bonus program that was allowed to operate alongside it. 

That pushed Sinclair's total earnings for the year, including his base salary ($375,053) and contributions Vestcor made to his pension account ($115,386) to $1.77 million.

Three other senior executives who had shared just under $1 million in bonus pay in 2020, shared $2.16 million in 2021.  Most of that increase came from $766,300 generated from the still active older bonus program that was allowed to run alongside the new program.

Sinclair emailed response

In an email, Sinclair noted an external consultant hired by Vestcor approved the concept of the two bonus programs running at the same time until the "deferral process" of the new bonus plan fully unfolds.

Also, Sinclair said the portion of the old bonus program that is still running was designed to pay amounts based on four-year results and so has a natural lag time built into it.

"The long-term four-year focus, and implied waiting period to receive the applicable payout, provided a strong alignment with long-term client objectives while also providing a strong long-term employee retention motivation," wrote Sinclair. "The wind down … completes the previously initiated four-year cycles."

However, according to Vestcor's annual report, the two bonus programs overlap in significant ways and operating them at the same time has resulted in employees being rewarded twice for the same achievement. 

Both, for example, reward employees when investment returns hit levels above targeted amounts over four-year periods. 

In 2021, Vestcor reported its funds earned combined returns over four years of 7.5 per cent, 0.98 per cent above the target amount. That triggered substantial rewards for Vestcor employees from both bonus pools.

On that point, Sinclair suggested that is natural given both the "legacy" bonus scheme and new one were designed to reward the same long-term results, "resulting in a strong focus on the importance of four-year client returns."

Pension Coalition NB “the Coalition "unfortunately must now close the case.

Despite our efforts to support 2 (two) legal cases over the past 9 (nine) years, namely the
Kennedy case and more recently the Lévesque case, we have faced three formidable legal
teams funded by your taxes, as well as by your pension fund which is now managed by
VESTCOR, a company which was privatized in order to avoid any verification and transparency,
despite the management of 100% public funds.


The Coalition is proud to have been able to expose the Government for being guilty of violating
your rights and infringing on your access to a judicial system, both supposedly dedicated to
enhancing the public interest.

Due to our decision to end our efforts, the Coalition will close shop at the end of April 2022. We

would like to remind you that your contribution to our legal fund is fully tax deductible.
With the recent Court decision by Chief Justice Mme Tracey DeWare, against the Lévesque
case, the Coalition has decided to cover all outstanding legal costs for the Kennedy et al and
Lévesque cases. Then, the remaining funds in the operating account (legal account is empty)
will be used to pay the remaining operating expenses (mail box, telephone, website) and the
balance will be sent to CUPE-NB, as they have assisted in funding the Lévesque case for the
last few years. The Coalition's Summary of the Financial Statements for the period 2013-2022
will be sent to all our members and will be posted on our website www.pensioncoalitionnb.ca
and Facebook page for transparency purposes.

Finally, we would like to thank you from the bottom of our hearts for your continued support over
all these years. You allowed us to expose this Government and the various union
representatives who signed a memorandum of understanding breaking our Defined Benefit
Pension Plan. They were subsequently appointed as trustees with immunity under the new law
governing the Shared Risk Pension Scheme. Quite a story, isn’t it? The United States faced the
“Watergate“ scandal. Hopefully, we will see the day when the “PensionGate” scandal will be
exposed.

Employers urged to embrace dialogue as a way to avoid legal pitfalls
of pension innovation

Canada’s workplace pension system is going through a recalibration due
in part to an aging population and demographic shifts, declining
coverage and unpredictable financial markets.

None of these is the fault of employers, unions or pensioners.

One result of the recalibration is the opportunity for pension
stakeholders to innovate workplace pension plans. In the broader
public sector and the area of skilled trades, where both coverage and
concentration are high, there’s an opportunity to address all of the
realities in the pension sphere when it comes to governance, funding,
economies of scale, vested rights and future benefits.

The risks of litigation - Litigation is one way to bring about change
but it’s always uncertain and usually very expensive.

In New Brunswick, the provincial government sought to reduce pension
costs by implementing a new public service plan. The result is three
active lawsuits against the province by employees and pensioners, two
of which allege a breach of the Charter of Rights and Freedoms.

In another instance, Telecommunications Employees Association of
Manitoba v. Manitoba Telecom Services Inc., the company’s
privatization led to 12 years of litigation on the new pension
arrangement and went all the way to the Supreme Court of Canada. After
several million dollars in legal fees, the top court ruled on a
question of law and then directed the parties to work out “an
appropriate implementation process that adequately protects the
interests of all of the relevant beneficiaries.”

Within six months, the company, unions and a pensioner group reached a
facilitated resolution, held meetings with affected beneficiaries and
went back to the trial judge, who adopted a settlement binding
everyone. All of that happened within the same calendar year as the
Supreme Court decision.

Finding consensus - There are many benefits to seeking consensual
resolutions to pension issues. And given the public interest in
negotiating solutions aimed at stabilizing pension funding,
governments have rolled out legislation across Canada offering new
templates for renewed deals that leave the stakeholders to work out
the specifics.

Some regulations are time-sensitive. In British Columbia, the end of
2017 is the deadline for certain employers and unions to negotiate
changes to their current pension structures.

While the clock ticks, many in the pension community are debating the
merits of the new templates, such as target-benefit or hybrid pension
plans.

But the fact is that almost any change seeking to stabilize pension
costs involves shifting risk to the beneficiaries. That’s why
employers that want to open a pension contract have to explain clearly
why they need relief and what they can offer instead of contractual
certainty.

For employees, unions and pensioners, the case for a pension trade-off
may not feel immediately obvious, especially when faced with a less
secure deal on benefits.

Process is key - As a result, conversations with members are
particularly important in making the case for pension innovation. That
means changing conventional thinking on the pension deal by loosening
binary positions on the relative merits of the benefit formula and who
backs the guarantee and instead focusing on the process of change.

Legal risks are inherent in any pension change involving a shift of
financial risk. But plan sponsors can mitigate the risks through
meaningful processes leading to informed compromises that respectfully
consider all interests in the plan.

Ari Kaplan is a partner at Koskie Minsky LLP and an adjunct professor
of law at the University of Toronto.

The CROWN tries to call me crazy or frivolous or vexatious but all the
very evil lawyers/politicians/banksters such as Franky Boy McKenna and
everybody else and his dog knows that I have gone to great lengths and
personal expense to prove that Democracy, and Justice are myths in a
dog eat dog world. History had proven to me that if any ethical
whistlerblower or cop or journalist attempted to spill the beans they
were quickly pounded into the ground. So I covered my bases bigtime IN
2001 in my best effort not to make the same mistakes other decent
people made when dealing with corrupt public officials. In that regard
I appear to be a raging success. I am the only whisteblower I know of
to still be free and litigating in the pursuit of justice after so
many years of battling the sustem and running for public office while
most people pretended that I did not exist countless Trolls on the
Internet tried hard to discredit me. Ask the crooks within Wikileaks
or the crooked lawyer Glen Greenwald or the Ministers of Justice in

I speak Pro Se and I may intervene in your legal action as is my
right. Also for the record Judge David Smith and I have had one brief
personal converstion. I called him months ago in order to make certain
that he knew who I am and what I am up to. I will deal with Judge
Smith and the lawyers in the Canadian Judicial Council byway his
lawyer Michael Bray from now on and they all know it as well.

For the record I have always looked at Blaine Higgs' sneaky game for
the benefit of his Bankster buddies as evil being evil even unto
itself because it was bureaucrats who were assisting him in screwing
themselves. The truly sick part of it all was their mindless Union
Bosses went along with it for no reason I will ever understand.

This is all so smple to me. Foe instance way back in 2007 before the
economy took a nosedive when the retired Millworkers in Nackawic got
screwed, blued and tattoed by a bunch of crooks. Once you retire, your
employer can’t reduce your retirement benefits and the CROWN should
have made certain of it and prosecuted the crooks. Kirk macDonald and
TJ BUrke and the all rest cannot deny that I said my two bits about
that at the time. MORE IMPOrTANTLY does anyone recall my bitching
about Victor Boudreau's budget in 2009 toppping up the the pension
plan losses on the the Stock market one year after the RCMP had me
illegally locked up in the Looney Bin of the DECH?

Six years later Blaine Higgs begins his song and dance. Yet at the
very same point in time there is a decision involving Lorne Lacey and
Weyerhauser on May 28, 2013. DUHHHH???? The B.C. Court of Appeal
determined that, if employees were told they would have certain
retirement benefits  and they worked on that basis, an employer could
not reduce those benefits after they retire. This is because the
retirement benefits were actuallly earned by the employee while they
were working and are a form of deferred compensation. Imagine snobby
judges in BC agreeing with a mean old Maritimer?

Province's investments saw 2% gain last year, despite significant declines in global stock markets



The organization handling New Brunswick government pension and other funds awarded its employees a record $5 million in bonuses last year, including $902,438 to its president after the province's investments managed to post a two per cent gain, despite significant declines in global stock markets.

Vestcor is the Fredericton-based investment firm set up by the province to manage what has become $16.9 billion in funds, including retirement savings for provincial civil servants, teachers and most hospital workers.

Vestcor also invests pension money for the University of New Brunswick and the City of Fredericton and handles hundreds of millions of dollars set aside by NB Power to deal with the eventual decommissioning of the Point Lepreau nuclear generating station and its stockpile of nuclear waste.



According to its latest annual report, Vestcor posted a 2.08 per cent gain on investments in 2018 — less than the rate of inflation — but significantly better than pension plans across the country, many of which bled money during the year thanks to turbulent stock prices.
In a letter attached to the annual report, Vestcor's chairman Michael Walton said it was "gratifying" that the organization was able to post gains in what he called "the generally negative financial market environment" of 2018.

In February, the Royal Bank's Investor and Treasury Services division reported that Canadian defined benefit pension plans overall lost 0.7 per cent of their value in 2018, placing Vestcor's result in the top tier of performances nationwide.

That helped fuel another boost in employee performance bonuses, which have grown significantly at Vestcor in recent years.

Vestcor's long-time president John Sinclair saw his pay package in 2018 hit a new high of $1.39 million, a 9.5 per cent increase over 2017.

Bonuses exceed salary by 200%


Sinclair's base salary is $351,389 and, although Vestcor guidelines show the upper target for executive bonuses allows for another 130 per cent on top of that, Sinclair's bonus was once again well above that upper range.

He earned $902,438 in bonuses in 2018 — what Vestcor calls "incentive pay"—  just under 257 per cent of his base salary.

 
Vestcor had more than $6 billion invested in global stock markets in 2018 and lost money on many of those holdings, like the $7 million it had invested in the struggling General Mills as markets plunged. But with $10 billion invested in other areas, such as real estate and private companies, Vestcor managed to overcome those losses and post overall investment gains for the year. It's at least the fourth year in a row Sinclair's bonuses have exceeded his salary by 200 per cent or more.

Other Vestcor executives earning bonuses in excess of 130 per cent of their base pay in 2018 include chief investment officer Jonathan Spinney, who was awarded bonuses of $466,628 (190 per cent of his salary), vice-president Daniel Goguen, who earned $344,476 on top of his base pay (161 per cent), and vice-president James Scott, whose bonuses totalled $328,891 (143 per cent).

Extended to all employees 

Bonus payments at Vestcor have doubled over the last four years and, in 2018, were expanded to cover all employees — not just those involved in making investment decisions.

"This change provides further alignment with the performance of our clients and ensures we continue to be able to attract and retain talent while competitively keeping pace with other similar service providers in our industry," wrote Walton in the annual report.

Vestcor defended bonus payments as a way to reward strong performance and attract and retain talented employees. It also noted the practice is common in the investment field.

However, Vestcor has never explained why the range it sets for employee bonuses of between 30 and 130 per cent of base pay is routinely exceeded by its top executives.

Vestcor does claim that its senior executives have beaten their investment targets by a combined $567.1 million over the last four years, including by $171.6 million in 2018 — the basis of the elevated bonuses.

Reply to @David Amos: I'm not sure what you mean - the Public Service pension plan and the NB teachers pension plan own Vestcor ... they manage the funds for those two pensions, but they also mange the funds for over a dozen other plans. Those other plans have zero ownership in Vestcor, they pay Vestcor to manage their funds.

Wow 2% the Canada Pension Plan made an 8% gain so really Vestcor did really bad in investing but still get outrageous bonuses. Something has to be done about this be cause really it's criminal. The CPP directors spent 3.2 of the 3.9 billion $ of money that Canadian's contributed to the plan in a year and now I read about this in the N.B pension plan. Just imagine how much more money we would be receiving from for pensions if we weren't getting ripped off by these directors of these pension plans

I'm not sure why we are giving bonuses to peole simply because they have done their jobs properly. Their job was to invest so the fund would grow, and that is exactly what they did. And right now, you can get 1.9% in a savings account in some banks, so 2%, when we had to spend all this money to get it doesn't look that good. Next year, if they don't make money, with they pay a $5 million penalty to the government???

This is the same pension plan that will not pay inflation raises to pensioners if they judge the fund did not earn enough more than the CPI but the president gets more than double his salary even when the fund earned less than the inflation rate?

Many commenting here would sooner see their investments with one of the majority of fund managers that lost money last year and who most likely had Company Presidents who would have made in excess of 1 million dollar salaries with smaller bonuses than one that made 171 million dollars last year. I'd have expected more thought put into this by Canadians , Americans maybe less , but not Canadians . I'm extremely happy with the way my pension is handled thank you !

Interesting . Any complainers who've been denied their cost of living ? Nope. Appears some former government employees commenting here still expect not only their cost of living but still expecting A RAISE !! Every year one gets a printout of what they can expect to get on retirement. And it appears their sense of entitlement indicates in the good years they expect a lot more , and yet don't want to take a cut in bad years. The present setup is exactly the reason they want to avoid running into what the CPP ran into ! Not too hard to understand if one knows anything about economics at all.

Board members for pension plan appointed

FREDERICTON (GNB) – The provincial government and the New Brunswick Teachers Federation have each appointed four members to the board of trustees for the New Brunswick Teachers’ Pension Plan.

“Members of the Teachers’ Pension Plan can have confidence in this highly qualified board of trustees,” said Finance Minister Blaine Higgs. “The candidates chosen represent a wide-range of skills and experience as recommended by national pension plan governance best practices.”

“The federation trustees and observers were selected by the Executive Committee in June for a five-year term,” said federation co-president Philippe Cyr.

The trustees are responsible for overseeing the investment of the pension funds and the day-to-day administration of the plan. The trustees will follow the requirements of the Teachers’ Pension Plan Act, Pension Benefits Act, the Pension Plan's Funding Policy, Investment Policy and the Plan Text to ensure it is managed in a prudent manner to meet the its objectives.

“The establishment of pension plan trustees represents another important step in the process of reform to the Teachers’ Pension Plan that will ensure a long-term sustainable benefit for teachers,” said federation co-president Peter Fullerton.

The board of trustees will begin work immediately. The eight members are:

  • Chair:Larry Jamieson is the executive director of the New Brunswick Teachers Association. He has experience on a number of different boards and has worked closely to provide pension advice to teachers during the past 12 years as a staff officer with the association. He has a bachelor of education and a master’s degree in education administration from the University of New Brunswick.
  • Vice-chair:David Nowlan is the director of audit and consulting services in the Office of the Comptroller of the Province of New Brunswick. He has many years of experience in providing accounting, risk and control advice both in and outside of government.  He received a bachelor of commerce from Dalhousie University.
  • Jane Garbutt is the deputy minister of the Department of Finance. She sits on a number of boards, including the New Brunswick Investment Management Corporation. She has a master’s degree in business administration from the University of New Brunswick.
  • Marcel Larocque is the deputy executive director of L’Association des enseignantes et des enseignants francophones du Nouveau-Brunswick. He has experience on a number of different boards and has worked closely to provide pension advice to teachers during the past five years as a staff officer with the association. He has a bachelor of education and science and a master’s degree in education administration from l’Université de Moncton.
  • Leonard Lee-White, CFA is the assistant deputy minister of Finance, treasury division, and has many years of experience in providing pension plan investing and risk management advice to government and boards of trustees. He has a master’s degree in business administration from the Ivey School of Business and engineering and science degrees from Dalhousie University.
  • Jennifer Morrison, CA is the director of trust fund administration, treasury division, Department of Finance. She has many years of experience in providing pension plan investing, risk management and accounting advice to government and boards of trustees. She received a bachelor of science (economics) from Mount Allison University.
  • Mike Springer is the former director of teacher welfare services with the New Brunswick Teachers Association where he advocated for and assisted teachers in their pension decisions.  He retired from the association in 2002.  He has a master’s of education in school counselling from the University of Maine.
  • Reno Theriault is the former executive director of L’Association des enseignantes et des enseignants francophones du Nouveau-Brunswick. He has a bachelor of commerce, a bachelor of education and a master’s degree in school administration, all from the Université de Moncton. He sits on a number of boards including the New Brunswick Investment Management Corporation.

In addition, the federation has appointed two observers to the board:

  • Bob Fitzpatrick is the former executive director of the New Brunswick Teachers’ Association.  He was a teacher and administrator in the province and has extensive experience on a variety of boards and with the governance process. 
  • Caroline Foisy is a labour relations officer with the New Brunswick Teachers’ Federation. She has a bachelor in industrial relations from Laval University and a master’s degree in public administration from L'ENAP (école nationale d'administration publique de Québec). She is currently a member of the board of Le petit Monde de Franco as the treasurer.

Subsequent to the board's appointment, the trustees will enter into agreements with the New Brunswick Investment Management Corporation to continue to invest the plan's assets as well as with the Pension and Employee Benefits Division of the Department of Human Resources to continue to provide pension administrative services.
