I am disappointed that the Law Society of Ontario - of which I am a member - has chosen not to admit lawyers who graduate from the law school at Trinity Western University.
Evidently the objective of promoting greater tolerance and diversity only applies to people, beliefs and causes that a majority of the benchers agree with. The benchers remind me of those small groups of radical activities on university campuses, who believe in free speech only when they approve of speakers' messages, and try to prevent anyone from speaking with whom they disagree.
If the law school at Trinity Western was the only law school in the country, there would be merit in the benchers' stance. However a gay or lesbian person has many law schools to choose from, that don't ask unmarried students to abide by a covenant to remain celibate.
Support for politically correct causes like gay rights allows the benchers to feel good about themselves without threatening their incomes.

I watched the SCoC hearing and based on that I can say that what a lot of posters are claiming here in terms of TWU discrimination is not accurate. Anyone of any religion can attend, they just have to agree to the pledge. From what I saw the Law Societies' cases were pretty flimsy and the Justices didn't seem too impressed. I predict TWU will win this one.

Trinity Western is not an individual, and as such does not have those constitutional rights. Only individuals have those rights, and the right of individuals not to be discriminated against is being violated by Trinity Western. They get away with it as a private institution, but that doesn't mean public organizations need to legitimize the practice by recognizing their work.

@Winston Smith But this ruling goes beyond "you're more than welcome to believe what you want" to "you can believe what you want but you can't have a law school." That's a step too far. You are of course free to ridicule as you see fit (I might suggest kindness as a default response but that's a different discussion), the problem here is that as far as I can tell TWU isn't bothering anyone and solely because of their beliefs they're being denied a law school. That worries me.
As for your point about Catholic school I don't know about where you live but I know that every year I check a box indicating that I want my tax dollars to go to the public education system rather than the Catholic so I assume that the Catholic system is pretty self sufficient.

@David Amos Clearly you don’t spend much time in catholic schools then. My athiest sister worked as a teacher at one. The school was roughly 60% Muslims with the rest Christian or agnostic. Religion was not on the curriculum.

The Justice Centre is representing a non-profit human rights advocacy
group in a court action against the City of Edmonton. The City
cancelled bus advertisements that opposed the “honour killings” of
women and girls, in response to complaints about the ads.
In October of 2013, ads ran on Edmonton Transit buses reading “Muslim
Girls Honor Killed By Their Families”, showing photos of Aqsa Parvez
and six other women, murdered for choosing to live by Western values

AFDI v. City of Edmonton
The Justice Centre is representing a non-profit human rights advocacy
group in a court action against the City of Edmonton. The City
cancelled bus advertisements that opposed the “honour killings” of
women and girls, in response to complaints about the ads.
In October of 2013, ads ran on Edmonton Transit buses reading “Muslim
Girls Honor Killed By Their Families”, showing photos of Aqsa Parvez
and six other women, murdered for choosing to live by Western values
like women’s equality. The rest of the ad read “Is your family
threatening you? Is there a fatwa on your head? We can help: go to
FightforFreedom.us”.
So-called “honour killings” occur when a woman is considered to have
sullied the family’s honour through some sexual indiscretion, or even

Trinity Western loses fight for Christian law school as court rules limits on religious freedom 'reasonable'
Supreme Court of Canada says 7-2 decision will ensure open access for LGBT students

Christian university has lost its legal battle over accreditation for a planned new law school, with a Supreme Court of Canada ruling today saying it's "proportionate and reasonable" to limit religious rights in order to ensure open access for LGBT students.
In a pair of 7-2 rulings, the majority of justices found the law societies of British Columbia and Ontario have the power to refuse accreditation based on Trinity Western University's so-called community covenant.
The majority judgment said the covenant would deter LGBT students from attending the proposed law school, and those who did attend would be at risk of significant harm.
It found the public interest of the law profession gives it the right to promote equality by ensuring equal access, support diversity within the bar and prevent harm to LGBT students.
Two justices: law societies' powers should be limited
In the court's view, the law societies were acting within their mandate in considering TWU's admission policies in the accreditation process, and striving to uphold a positive public perception of the legal profession."In our respectful view, the [law societies] decision not to accredit Trinity Western University's proposed law school represents a proportionate balance between the limitation on the Charter right at issue and the statutory objectives the [law societies] sought to pursue," it reads.
Two dissenting justices, Suzanne Cote and Russell Brown, sided with TWU, arguing that the law societies' powers should be more limited when it comes to approving law programs.
TWU's proposed law school at its Langley, B.C., campus was granted preliminary approval by the B.C. provincial government in 2013, but that approval was later withdrawn due to legal challenges.
In B.C. and Nova Scotia, the courts had sided with TWU, ruling the university has the right to act on its beliefs as long as there is no evidence of harm.
Ontario's Court of Appeal ruled the other way, calling the covenant "deeply discriminatory to the LGBT community."
Mandatory covenant
The university's mandatory comprehensive covenant agreement requires that all students and faculty pursue a holy life "characterized by humility, self-sacrifice, mercy and justice, and mutual submission for the good of others." It requires members to abstain from using vulgar language, lying or cheating, stealing, using degrading materials such as pornography, and "sexual intimacy that violates the sacredness of marriage between a man and a woman."
While that rule effectively bars anyone who is unmarried from having sexual relations, it's the reference to "man and a woman" that is considered discriminatory against LGBT people. Same-sex marriage became legal in Canada in 2005.
TWU has 40 undergraduate programs and 17 graduate programs, including a teachers' education program.
'Loss for diversity'
Janet Epp Buckingham, a TWU professor who helped develop the law school proposal, said she was saddened by the ruling.
"We feel that this is a loss for diversity in Canada," she said. "Canada has traditionally upheld values of diversity for a broad array of religious views. So we're very disappointed in the way the Supreme Court of Canada has ruled today."
Buckingham said the university will take time to process the long and complex judgment before deciding on next steps. One option the university's board of governors could consider is lifting the mandatory covenant, she said.
Other professional programs at the university, such as the teaching and nursing programs, have been operating successfully for years, turning out graduates who are well-respected in the community, Buckingham said. She said she does not anticipate any challenges to those programs, whose students are also required to sign the covenant.
Law Society of B.C. President Miriam Kresivo called the ruling "a recognition of the responsibility of the Law Society to uphold the rights of all persons and to protect the public interest.
"The court recognized that the Law Society has an overarching interest in protecting equality and human rights, as well as ... removing inequitable barriers to the legal profession, in carrying out our duties and ensuing public confidence."
But Andrew Bennett, director of the religious freedom institute at the Christian-based think tank Cardus, said the ruling could have broader implications for other professions such as medicine, and for other religious schools.
He said the Supreme Court has affirmed and advanced an "imagined conflict" between sexual and religious identities.
"This is not a question of religious identity, it's not a question of sexual identity. It's a question of fundamental freedoms, and also about the freedom to live your faith publicly," he said.
Access to justice
Bennett said the ruling takes a narrow view, suggesting that freedom of religion and conscience are only to be exercised privately.
The Law Society of Ontario applauded the decision for respecting its objective of promoting a diverse bar.
"Access to justice is facilitated where clients seeking legal services are able to access a legal profession that is reflective of a diverse population and responsive to its diverse needs," said treasurer Paul Schabas.
"Accordingly, ensuring a diverse legal profession, which is facilitated when there are no inequitable barriers to those seeking to access legal education, furthers access to justice and promotes the public interest."

The judgment effectively could determine whether Trinity Western University (TWU) — a private, evangelical Christian post-secondary institution — can operate a law school at its Langley, B.C. campus.
Law societies in B.C., Nova Scotia and Ontario have refused to accredit Trinity's program, arguing that the school's "community covenant"— which requires students to abstain from sex outside heterosexual marriage — discriminates against LGBT people.
In B.C. and Nova Scotia, the courts have sided with TWU, ruling the university has the right to act on its beliefs as long as there is no evidence of harm.
Ontario's court of appeal ruled against TWU, calling the covenant "deeply discriminatory to the LGBT community."
Peter Gall is representing the Law Society Of British Columbia in the case. He said the case is both important and a difficult call for the high court to make, since it seeks to reconcile one human right — freedom from discrimination — with another, namely freedom of religion and association.
He said the Supreme Court will have to decide if there should be some special recognition of the public's interest in keeping the legal profession open to all, in order to deliver "even-handed justice."
Equal access for all
"The argument is that it is of fundamental importance that people have an equal ability to participate in the legal system and have confidence that the legal system is going to treat everybody in an equal manner," he said.
TWU's proposed law school was granted preliminary approval by the B.C. provincial government in 2013, but that approval was later withdrawn due to legal challenges.
Those who break the covenant can face disciplinary action, such as suspension or expulsion.
While some see the sexual prohibition in the covenant as discriminatory, Earl Phillips, the executive director of the proposed TWU law school, said it would be discriminatory to bar students from practising law because they trained in a school that embraces a traditional conception of Christian faith.
Discrimination against students?
"Why should a law school graduate not be accepted into the legal profession because they chose to go to a school where there are traditional Christian values?" he said.
Phillips said the case boils down to the question of whether diversity in Canada leaves room for a law school at a small university that holds traditional Christian values.
Brayden Volkenant, a TWU graduate who petitioned in the case, said there were gay and lesbian students on campus, and noted that the covenant's sexual prohibition applied across the board to all students who weren't married. He said he saw the rule as more of an "accountability tool" than something that was rigidly enforced.
"I saw it as more of a, 'We're in a community together, this is how we want to strive to live.' An aspirational thing," he said. "That's how I saw it when I was attending, and I think that's how it played out practically."
Volkenant said he had hoped to attend law school at TWU, but ended up going to the University of Alberta because the program was in limbo.
The TWU case drew an unusually high number of interveners — 24 in all.
Eugene Meehan, a lawyer representing the International Coalition of Professors of Law and the National Coalition of Catholic School Trustees' Associations, said there is a significant division between the parties in this case — and the fact that courts in B.C. and Ontario took different approaches to it reflects uncertainty in the law.
"Many parties are in favour of accreditation on the basis that we live in a multicultural society, and a necessary part of that is that people will follow religions with views that others may find offensive," he said.
"Should the law protect these religious beliefs or prohibit them? For some that oppose accreditation, the view is that religious freedom that interferes with equality has no place in a secular society."

"We are a private institution and we operate in a way that is consistent with our Christian faith," Phillips said. "This is not just a restriction on Trinity Western University, this is not just on Evangelical Christians — it's on the entire Christian church. It's on all faiths."
The law societies, however, argue that TWU's covenant discriminates against the LGBT community. The issue was taken to court in British Columbia, Nova Scotia and Ontario.

The applicant Law Society of British Columbia (“LSBC”) denied accreditation to the law school of the respondent Trinity Western University (“TWU”). TWU is a private post-secondary institution in British Columbia that provides an education founded on evangelical Christian principles. TWU’s approach to community development was expressed in a Community Covenant, a code of conduct that encouraged or discouraged certain behaviour based on evangelical Christian notions of Biblical teaching and morality. The covenant prohibited sexual intimacy that violated the sacredness of marriage between a man and a woman. Unmarried individuals were expected to live chaste, celibate lives. TWU did not prohibit admission to lesbian, gay, bisexual or transgendered (LGBTQ) students, and the covenant prohibited any forms of discrimination or prejudice. However, TWU did prohibit admission to its law school if a student refused to sign the covenant. In 2014, the LSBC held a binding referendum amongst its members on the issue of whether TWU’s law school should be approved as a recognized law faculty for the purpose of admission of graduates to the bar. Based on the referendum outcome, the LSBC refused recognition. The respondents, TWU and its representative student (“TWU et al.”), sought judicial review. The reviewing court found that the LSBC’s refusal to accredit TWU on the basis of its admissions policy was directly related to the LSBC’s statutory mandate. It also held that the LSBC correctly found that it had discretion to disapprove the academic qualifications of a law faculty, so long as it followed the appropriate procedures and employed the correct analytical framework.
However, the Benchers’ delegation of the issue to members, and consequent acceptance of the outcome of the membership referendum, constituted an impermissible delegation and fettering of their discretion, as it ignored their obligation to consider and apply the proportionate balancing of the competing Charter rights at issue related to same-sex marriage and religious freedoms. Therefore, the reviewing court set aside the LSBC’s refusal decision. The LSBC appealed, but unsuccessfully.
